Justice ANTONY DOMINIC\n\n Dated :13\/03\/2008\n\n O R D E R\n                           ANTONY DOMINIC, J.\n\n               ------------------------------------\n\n                          W.P.(C) 8523 of 2008\n\n              -------------------------------------\n\n                        Dated: MARCH 13, 2008\n\n                               JUDGMENT\n<\/pre>\n<p>      The petitioners were the claimants in OP(MV) 283\/1999 and<\/p>\n<p>1029\/1999 on the file of the MACT, Muvattupuzha.             Petitioners<\/p>\n<p>contend that by Ext.P1 common award passed by the Tribunal<\/p>\n<p>though compensation was awarded, payment has not been made as<\/p>\n<p>on date. It is in view of this that the writ petition has been filed.<\/p>\n<p>      2. I heard learned counsel for the 1st respondent whose only<\/p>\n<p>justification is financial constraints.<\/p>\n<p>      3. Since the award has become final and binding between the<\/p>\n<p>parties, financial constraints cannot be a reason to justify the<\/p>\n<p>inordinate delay that is already caused. I am satisfied that the 2nd<\/p>\n<p>respondent is liable to honour the terms of Ext.P1 award.<\/p>\n<p>      Accordingly I dispose of this writ petition directing that the<\/p>\n<p>compensation awarded by Ext.P1 shall be deposited by the 1st<\/p>\n<p>WP(C) 8523 of 2008<br \/>\n                          Page numbers<\/p>\n<p>respondent as expeditiously as possible, at any rate, within three<\/p>\n<p>months of production of a copy of this judgment.<\/p>\n<p>                                         ANTONY DOMINIC, JUDGE<\/p>\n<p>mt\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sudha.
