He is not the seller of<br \/>\n\tthe land. He had agreed to purchase the said land by agreement<br \/>\n\tentered in the year 1990. He further pointed out that for the<br \/>\n\talleged offence transaction in the year 1989-90, present complaint<br \/>\n\thas been lodged in the year 2009.\n<\/p>\n<p>Considering<br \/>\n\tthe above aspects of the matter,  I find that this is a fit case for<br \/>\n\tgrant of anticipatory bail.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, by allowing this application, it is ordered that<br \/>\n\tin the event of arrest of the applicant in connection with C.R.<br \/>\n\tNo.M.Case No.1 of 2009, he shall be released on bail upon his<br \/>\n\tfurnishing a bond of Rs. 25,000\/-(Rupees Twenty Five Thousand) with<br \/>\n\tone surety of like amount to the satisfaction of the lower Court and<br \/>\n\tsubject to the following conditions :\n<\/p>\n<p>[A]\tshall<br \/>\ncooperate with the investigation and make himself available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[B]\tshall<br \/>\nremain present at concerned Police Station  on 21,1,2011 between<br \/>\n11:00 am to 2:00 pm:\n<\/p>\n<p>[C]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[D]\tat<br \/>\nthe time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[E]<br \/>\n\twill not leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately<\/p>\n<p>[F]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>[G]\tThis<br \/>\norder will be operative if the applicant is arrested at any time<br \/>\nwithin a period of 90 days from today .\n<\/p>\n<p>[H]\tWithin<br \/>\na period of ten days from the date of arrest, the applicant shall<br \/>\napply for regular bail which application shall be decided by the<br \/>\ncompetent Court in accordance with law without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>\tRule<br \/>\nmade absolute.
