No.<br \/>\nI &#8211; 20 of 2010  filed before the Kuvadava Road Police Station, Rajkot<br \/>\nfor the offence punishable under sections 436 and 114 of the Indian<br \/>\nPenal Code.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Chhaya, learned advocate for the applicants submitted that the<br \/>\napplicants are innocent persons and a false case is foisted on them.<br \/>\nHe submitted that considering the role attributed to the applicants<br \/>\nand reflected in the FIR at Annexure &#8216;A&#8217; to the petition, this is a<br \/>\nfit case to enlarge the applicants on regular bail.\n<\/p>\n<p>\tAs<br \/>\nagainst the aforesaid, learned APP Ms. M.L. Shah submitted that<br \/>\nconsidering the role played by the applicants along with other<br \/>\nco-accused, and the provisions of sections 436 and 114 of the Indian<br \/>\nPenal Code, no discretionary relief can be granted to the applicants,<br \/>\nand the application deserves to be dismissed.\n<\/p>\n<p>\tHaving<br \/>\nheard the rival submissions of learned advocates and having<br \/>\nconsidered the role attributed to the applicants and reflected in the<br \/>\nFIR at Annexure &#8216;A&#8217; ,  the provisions of sections 436 and 114 of the<br \/>\nIndian Penal Code and the quantum of punishment etc., I am of the<br \/>\nview that the the applicants are required to be enlarged on regular<br \/>\nbail at this stage, without entering into the merits of the case and<br \/>\nwithout discussing the evidence in detail.\n<\/p>\n<p>\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the petition is allowed and<br \/>\nthe applicants are ordered to be enlarged on bail in connection with<br \/>\nC.R. No. I &#8211; 20 of 2010  filed before the Kuvadava Road Police<br \/>\nStation, Rajkot on executing a bond of Rs.10,000\/- [Rupees ten<br \/>\nthousand only] EACH with one surety EACH of the like amount to the<br \/>\nsatisfaction of the trial court and subject to the conditions that<br \/>\nthey shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>[b].\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c].\tsurrender<br \/>\ntheir passport, if any, to the lower court within a week;\n<\/p>\n<p>[d].\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e].\tmark<br \/>\ntheir presence at Kuvadava Road Police Station, Rajkot on any day of<br \/>\nevery first week of English calendar month between 9.00 AM and 2.00<br \/>\nPM. till the trial is over;\n<\/p>\n<p>[f].\tfurnish<br \/>\nthe present address of their residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change their<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g].\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\nService is permitted.\n<\/p>\n<pre>mathew\t\t\t\t\t\t\t[H.B.ANTANI,\nJ.]\n\n    \n\n \n\t   \n      \n      \n\t    \n\t\t   \u00a0\u00a0\u00a0\n\t   \n      \n\t  \t    \n\t\t   Top\n\t   \n      \n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Hamirbhai vs State on 18 February, 2010 Author: H.B.Antani,&amp;Nbsp;
