No.8265 of 2011\n                                           Harihar Rai\n                                              Versus\n                                      The State Of Bihar\n                                            -----------\n<\/pre>\n<p>4       30.06.2011               Heard learned counsel for the petitioner as well<\/p>\n<p>                     as learned Additional Public Prosecutor for the state.<\/p>\n<p>                                 Petitioner is languishing in jail custody since<\/p>\n<p>                     14.10.2010. It is stated that the petitioner was caught red<\/p>\n<p>                     handed with 23 kg Ganja.\n<\/p>\n<p>                                 The contention of learned counsel for the<\/p>\n<p>                     petitioner is that section-50 of the N.D.P.S. Act has not been<\/p>\n<p>                     complied with in the case and uptill now, the sample of<\/p>\n<p>                     seized Ganja has not been sent for chemical examination.<\/p>\n<p>                     The aforesaid contentions would be considered by the<\/p>\n<p>                     learned trial court at the time of trial.\n<\/p>\n<p>                                 Considering the recovery as well as submission<\/p>\n<p>                     of the parties, I do not feel inclined to release the petitioner<\/p>\n<p>                     on bail. Accordingly, the prayer for bail of the petitioner in<\/p>\n<p>                     connection with Palanwa P.S. Case No. 109 of 2010<\/p>\n<p>                     corresponding to N.D.P.S.
