Shah &amp; Doraiswamy Raju\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>Shah, J.\n<\/p>\n<p>\tBeing aggrieved and dissatisfied by the order passed by the<br \/>\nHigh Court of Judicature at Jabalpur, M.P., the accused has filed this<br \/>\nappeal.\t By the impugned judgment and order dated 19.3.2001, the<br \/>\nHigh Court confirmed the judgment and order passed by the<br \/>\nAdditional Sessions Judge, Umariya in Sessions Case No.117\/99<br \/>\nconvicting the appellant for the offence punishable under Sections 302<br \/>\nand 376 of Indian Penal Code and sentencing him to death.\n<\/p>\n<p>\tIt is the prosecution case that PW1 Mohan Lal Sahu when<br \/>\nreturned at his home at about 6.00 p.m. on 25th January, 1999, he<br \/>\nfound that his grand-daughter (daughter of his late daughter) Jyoti<br \/>\naged about 6 years was not present in the house.  He enquired about<br \/>\nher from his daughter-in-law and other persons.\t He was informed that<br \/>\nshe had gone to visit cinema alongwith the accused.  After some time<br \/>\nwhen accused Bantu @ Naresh visited his residence, he enquired<br \/>\nabout whereabouts of Jyoti and accused stated that he did not know<br \/>\nanything about Jyoti and that he had not taken her alongwith him for<br \/>\ngoing to cinema.  Thereafter, he and other family members and<br \/>\nresidents of the locality started searching Jyoti.  During the search,<br \/>\nfew people in the mohalla told his wife that deceased Jyoti was seen<br \/>\naccompanying the accused at about 4.00 p.m. and his wife informed<br \/>\nhim accordingly.  Thereafter, he along with his wife went at the house<br \/>\nof accused to know the facts correctly but as the accused became<br \/>\nangry on such enquiry, they came back.\tOn being advised by the<br \/>\npeople from the neighbourhood, he lodged the report at the police<br \/>\nstation. Subsequently, dead body of the deceased girl was noticed by<br \/>\nPW13 Sanjay Dube who was also neighbour of PW1.\t The dead body<br \/>\nwas found lying in the bushes standing across the railway line.\t He<br \/>\nnoticed that underwear of the deceased was lying near the dead body<br \/>\nand that there were blood stains and tooth mark on her cheek..\tHe<br \/>\nthereafter informed the police station.\t On the basis of the said<br \/>\ninformation, investigating officer carried out necessary investigation.<br \/>\nThereafter, accused-appellant was charge-sheeted alongwith Balu @<br \/>\nBalram Goswami.\t The Additional Sessions Judge convicted the<br \/>\nappellant but acquitted the other accused.\n<\/p>\n<p>\tFrom the evidence on record, the Sessions Court as well as<br \/>\nHigh Court arrived at the conclusion that the accused Bantu was<br \/>\nneighbour of complainant Mohan Lal Sahu and was on visiting terms<br \/>\nwith him.  After considering the other evidence, the Court held that on<br \/>\nthe evening of the day of occurrence the accused visited the house of<br \/>\nPW1 and he took the deceased Jyoti for visiting cinema.\t As Jyoti was<br \/>\nnot found at evening time and accused informed PW1 that Jyoti had<br \/>\nnot accompanied him, the report was lodged at the police station.<br \/>\nDuring the course of investigation by the police, accused absconded<br \/>\nand was not found in his house from 9.30 p.m. to 3.30 a.m.  He was<br \/>\narrested on the next day evening by the police.\n<\/p>\n<p>\tThe Sessions Court and the High Court relied on the evidence<br \/>\nof PW6 Vimla, daughter-in-law of PW1, PW4 Ravi, nephew of PW1<br \/>\nand PW5 child witness, and held that deceased had gone with the<br \/>\naccused after coming from the school.\n<\/p>\n<p>PW4 Ravi Kumar Lalla is nephew of PW1 Mohanlal Sahu.  He<br \/>\nstated that he is resident of Ratheli, district Umaria and PW1 resides<br \/>\nat Khalesar.  He further stated that on the day of incident, he was<br \/>\npresent at the house of his uncle.  When he was taking tea, accused<br \/>\nBantu, whom he was knowing, also reached there.\t Accused asked<br \/>\nhim that he wanted to take Jyoti to show her cinema and he forbid the<br \/>\naccused.  After a short while, he left for his home but he returned as<br \/>\nhe had forgotten his bag there.\t On the way, he noticed accused going<br \/>\ntowards the bazaar holding the hand of deceased Jyoti.\tPW5 Vivek<br \/>\nKumar Sahu, 8 years old son of Vijay Kumar and grandson of PW1.<br \/>\nHe identified the accused in the court and stated that at about 4.00<br \/>\np.m. he and deceased Jyoti had come to home from school.  After<br \/>\nkeeping school bag in the house, Jyoti went away to play.  He was<br \/>\nattending to his natural call on the drain near his house.  He saw<br \/>\naccused Bantu alongwith Jyoti.\tHe enquired from Jyoti as where she<br \/>\nwas going and she told him that she was going with accused Bantu to<br \/>\nsee picture.  He forbid Jyoti and told that mother would beat her, on<br \/>\nwhich Jyoti replied that she had taken permission from her<br \/>\ngrandmother.  He informed the same to his mother and grand-mother.<br \/>\nIn cross-examination, he denied the suggestion that he was giving his<br \/>\nstatement at the instance of his mother and grand mother.  PW10<br \/>\nManju stated that on the day of incident at about 3.00 to 4.00 p.m., he<br \/>\nwas sitting on the steps of the ghat of river, which is also called<br \/>\nRajrang ghat of Khalesar.  He saw accused Bantu catching of a girl<br \/>\nand carrying her, who was wearing school uniform.  On enquiry,<br \/>\naccused informed him that he was going at his brothers residence.<br \/>\nHe disclosed the fact to the people in the mohalla and neighbourhood.<br \/>\nHe came to know about the dead body of a girl lying near the railway<br \/>\nline on 26th January at about 12.00  1.00 p.m.\tIn the cross-<br \/>\nexamination, to the question that why he did not tell the police about<br \/>\nthe place where the dead body was lying, he replied that every body<br \/>\nremains afraid of police and why should one invite trouble, but when<br \/>\nthe police called him and made enquiry from him he told them the<br \/>\ntruth.\n<\/p>\n<p>PW8 Dr. (Smt.) S. Thakur who carried out post-mortem<br \/>\nexamination noticed that deceased was in a school uniform and she<br \/>\nstated that three doctors who had examined the dead body arrived at<br \/>\nthe conclusion that rape had been committed and the murder of<br \/>\ndeceased was committed by pressing her nose and mouth and<br \/>\nobstructing breath of the deceased.   PW9 Dr. A.P. Dwivedi had<br \/>\nexamined the accused and noticed that there was thin mark of scratch<br \/>\non the upper portion of penis.\n<\/p>\n<p>The learned counsel (amicus curiae) appearing on behalf of<br \/>\naccused appellant, appointed by us to assist the Court has taken has<br \/>\nthrough the entire evidence.  After going through the same, we do not<br \/>\nfind that the High Court or the Sessions Court committed any error in<br \/>\nappreciating the evidence led by the prosecution.  Hence, we confirm<br \/>\nthe conviction of the appellant for the offence punishable under<br \/>\nSections 302 and 376 IPC.\n<\/p>\n<p>However, the learned counsel for the appellant submitted that in<br \/>\nany set of circumstances, this is not the rarest of the rare case where<br \/>\naccused is to be sentenced to death.  He submitted that age of the<br \/>\naccused on the relevant day was less than 22 years.  It is his<br \/>\nsubmission that even though the act is heinous, considering the fact<br \/>\nthat no injuries were found on the deceased, it is probable that death<br \/>\nmight have occurred because of gagging her mouth and nosetrix by<br \/>\nthe accused at the time of incident so that she may not raise hue and<br \/>\ncry.  The death, according to him, was accidental and unintentional<br \/>\none.  In the present case, there is nothing on record to indicate that the<br \/>\nappellant was having any criminal record nor it can be said that he<br \/>\nwill be a grave danger to the society at large.\t It is true that his act is a<br \/>\nheinous and requires to be condemned but at the same time it cannot<br \/>\nbe said that it is rarest of the rare case where accused requires to be<br \/>\neliminated from the society.  Hence, there is no justifiable reason to<br \/>\nimpose the death sentence.\n<\/p>\n<p>In the result, we confirm the conviction of the appellant under<br \/>\nSection 302 IPC but modify the sentence by commuting the sentence<br \/>\nof death to an imprisonment for life.  For the offence punishable under<br \/>\nSection 376 IPC, he is sentenced to undergo rigorous imprisonment<br \/>\nfor 10 years.  Both the sentences to run concurrently.\tThe appeal is<br \/>\npartly allowed accordingly.\n<\/p>\n<p>Lastly, we mention and appreciate the proper assistance<br \/>\nrendered by the learned amicus curiae.\n<\/p>\n<p>\t\t\t\t\t\t..J.\n<\/p>\n<p>\t\t\t\t\t\t(M.B.
