Justice S.SIRI JAGAN\n\n Dated :10\/06\/2010\n\n O R D E R\n                               S.SIRI JAGAN, J.\n                    ---------------------------------------\n                          W.P.(C).No.3557 of 2010\n                    ---------------------------------------\n                  Dated this the 10th day of June, 2010\n\n                                J U D G M E N T\n<\/pre>\n<p>      Petitioner runs a wood based industry, which according to the<\/p>\n<p>respondents is within 5 k.m. from the edge of the forest. Petitioner<\/p>\n<p>has now been directed to stop the business, in view of the fact that<\/p>\n<p>petitioner does not have a valid NOC from the empowering committee.<\/p>\n<p>According to the petitioner, petitioner has already submitted an<\/p>\n<p>application for renewal of NOC, without considering which, the<\/p>\n<p>respondents are forcing the petitioner to close the saw mill. Petitioner<\/p>\n<p>therefore seeks the following reliefs:\n<\/p>\n<blockquote><p>            &#8220;i) To call for the records which may leads to the issuance of<br \/>\n            Ext.P14 order by the 4th respondent and quash the same as<br \/>\n            illegal, arbitrary and is one issued without any application of<br \/>\n            mind after issuing a writ of certiorari or other writ direction or<br \/>\n            orders.\n<\/p><\/blockquote>\n<blockquote><p>            ii) To issue a writ of mandamus or other appropriate writ,<br \/>\n            direction or order, commanding the first respondent to consider<br \/>\n            and pass orders in Ext.P15 application for grant of NOC to the<br \/>\n            wood based industry of the petitioner after complying with the<br \/>\n            mandates contained in Exts.P4, P9 and P10 judgments of this<br \/>\n            Honourable Court, for the forthcoming years as expeditiously<br \/>\n            as possible.\n<\/p><\/blockquote>\n<blockquote><p>            Iii) To issue a writ of mandamus or such other writ, order or<br \/>\n            direction, commanding the 4th respondent not to implement or<br \/>\n            proceed with Ext.P14 order till the first respondent consider<br \/>\n            and pass appropriate orders in Ext.P15 application for grant of<br \/>\n            NOC filed by the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>            iv) Such other appropriate writ order or direction this Hon&#8217;ble<br \/>\n            Court may deem fit and proper to meet the ends of justice.<\/p><\/blockquote>\n<p>      2. The learned Special Government Pleader submits that<\/p>\n<p>petitioner has been running the saw mill for sometime without a valid<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.3557 of 2010              2<\/span><\/p>\n<p>NOC and he is not entitled to continue the same. But he admits the<\/p>\n<p>fact that the petitioner had submitted an application for renewal of<\/p>\n<p>NOC and the same has not yet been disposed of. I am of the opinion<\/p>\n<p>that without first passing orders on the application for renewal of NOC,<\/p>\n<p>it is unjust for the respondents to take coercive action against<\/p>\n<p>petitioner to stop the business.\n<\/p>\n<p>       In the above circumstances, this writ petition is disposed of with<\/p>\n<p>a direction to the respondents not to interfere with the functioning of<\/p>\n<p>the saw mill until application for renewal of NOC filed by the petitioner<\/p>\n<p>is disposed by the appropriate authority.\n<\/p>\n<\/p>\n<p>                                              S.SIRI JAGAN, JUDGE<\/p>\n<p>cms<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.Jayakumar vs The Principal Chief Conservator &#8230; on 10 June, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 3557 of 2010(T) 1.
