Since statutory appeals as evidenced from Ext.P8 and<\/p>\n<p>P9, filed respectively against Ext.P6 order of assessment and<\/p>\n<p>Ext.P7 order imposing penalty, are pending consideration and<\/p>\n<p>disposal before the 1st respondent, I am of the opinion that the<\/p>\n<p>writ petition can be disposed of directing the appellate authority<\/p>\n<p>to have an early disposal of the appeals as well as the stay<\/p>\n<p>applications.\n<\/p>\n<p>      2.   Accordingly the 1st respondent is directed to consider<\/p>\n<p>and pass orders on Ext.P10 and P11 stay applications, filed along<\/p>\n<p>with the appeals, after affording an opportunity of hearing to the<\/p>\n<p>petitioner, as early as possible, at any rate within a period of one<\/p>\n<p>month from the date of receipt of a copy of this judgment.<\/p>\n<p>      3.   It is submitted by counsel for the petitioner that the<\/p>\n<p>assessment as well as order imposing penalty are totally<\/p>\n<p>unsustainable, because additions are made in the assessment<\/p>\n<p>mainly without considering the dispute regarding rate of tax<\/p>\n<p>applicable, and based on value of materials brought for own use<\/p>\n<p>in execution of the contract works treating it as sale. Since there<\/p>\n<p><span class=\"hidden_text\">W.P.(C).32414\/09-V                2<\/span><\/p>\n<p>is a strong prima facie case established, the petitioner is seeking<\/p>\n<p>stay till the disposal of the appeals by the appellate authority.<\/p>\n<p>      4.    However, considering the fact that the statutory<\/p>\n<p>appellate authority has not exercised its jurisdiction with respect<\/p>\n<p>to disposal of the stay petitions, I am issuing directions as above.<\/p>\n<p>Needless to say that the appellate authority while considering<\/p>\n<p>the stay petitions shall advert to contentions as stated above, and<\/p>\n<p>also other grounds taken in the memorandum of appeals.<\/p>\n<p>      5.    The respondents are directed to keep in abeyance<\/p>\n<p>realisation of amounts covered under Ext.P6 and Ext.P7,<\/p>\n<p>initiated pursuant to Ext.P12 and P13 notices, till orders are<\/p>\n<p>passed on the stay applications as directed above.<\/p>\n<p>      6.
