This application was made on<br \/>\n17.7.2009 which was withdrawn by petitioner on 23.4.2010. He also<br \/>\nsubmitted that petitioner will again approach to Magistrate Court,<br \/>\nJasdan with an application to permit the petitioner for issuance of<br \/>\npassport by passport officer.\n<\/p>\n<p>4.\tLet<br \/>\nsuch application may be made by petitioner before the Magistrate<br \/>\nCourt, Jasdan while joining the Regional Passport Officer, within a<br \/>\nperiod of 15 days from date of receiving copy of present order.\n<\/p>\n<p>5.\tAs<br \/>\nand when such application is received by the Magistrate Court,<br \/>\nJasdan, the Magistrate Court, Jasdan shall consider such application<br \/>\nand thereafter, to pass appropriate reasoned order  in accordance<br \/>\nwith law, after giving reasonable opportunity of hearing to<br \/>\nrespective parties, within a period of 2 months from date of<br \/>\nreceiving such application from petitioner and communicate the<br \/>\ndecision to petitioner immediately.\n<\/p>\n<p>6.\tIt<br \/>\nis made clear by this Court that before passing any order in such<br \/>\napplication, the Regional Passport Officer being a necessary party,<br \/>\nthe Magistrate Court, Jasdan must have to give hearing to Regional<br \/>\nPassport Officer.\n<\/p>\n<p>7.\tIn<br \/>\nview of aforesaid observations and directions, present petition is<br \/>\ndisposed of without expressing any opinion on merits.
