Justice R.BASANT\n\n Dated :21\/03\/2007\n\n O R D E R\n                                    R.BASANT, J\n\n                          ------------------------------------\n\n                             Tr.P(Crl).No.41 of 2007\n\n                          -------------------------------------\n\n                    Dated this the  21st day of March, 2007\n\n\n                                       ORDER\n<\/pre>\n<p>       The petitioner is the accused in a prosecution under Section 138<\/p>\n<p>of the N.I Act.  The respondent herein is the complainant. The case is<\/p>\n<p>now pending before the learned Judicial Magistrate of the First Class-<\/p>\n<p>VI,   Thiruvananthapuram.     The   petitioner   prayed   before   the   learned<\/p>\n<p>Sessions   Judge   that   the   case   may   be   transferred   to   the   court   at<\/p>\n<p>Neyyattinkara.     That   application   was   stoutly   opposed   by   the<\/p>\n<p>respondent.  The learned Magistrate, in these circumstances, rejected<\/p>\n<p>the   prayer.     Aggrieved   by   the   said   order,   the   petitioner   has   come<\/p>\n<p>before this Court.\n<\/p>\n<\/p>\n<p>       2.       The   learned   counsel   for   the   petitioner   submits   that   both<\/p>\n<p>parties are residing at Neyyattinkara going by the addresses shown in<\/p>\n<p>the   complaint   and   that,   in   these   circumstances,   a   direction   for<\/p>\n<p>transfer would only advance the interests for both sides.  The learned<\/p>\n<p>Magistrate did not look into the question of convenience of both sides,<\/p>\n<p>it is urged.\n<\/p>\n<\/p>\n<p>       3.       I find no merit in the prayer at all.  Convenience cannot be<\/p>\n<p>ascertained merely by looking at the place of the permanent address<\/p>\n<p>shown in the complaint.  It is evident that the respondent did not want<\/p>\n<p>the case to be transferred.   In these circumstances, the prayer is not<\/p>\n<p>founded on mutual convenience acceptable to both parties.<\/p>\n<p><span class=\"hidden_text\">Tr.P(Crl).No.41 of 2007                               2<\/span><\/p>\n<p>         4.    There         is         no         contention         that         the         Court         at<\/p>\n<p>Thiruvananthapuram is not the Court having territorial jurisdiction to<\/p>\n<p>deal with the matter legally.  The only grievance is that the petitioner,<\/p>\n<p>an   old   person,   will   have   to   travel   from   Neyyattinkara   to<\/p>\n<p>Thiruvananthapuram   to   conduct   his   case.     That   by   itself   cannot<\/p>\n<p>persuade the Court to order transfer.   The interests of justice will be<\/p>\n<p>best   served   if   the   petitioner   seeks   exemption   from   personal<\/p>\n<p>appearance.     I   find   no   reason   why   such   insistence   on   personal<\/p>\n<p>appearance can and must be made by a court when the prosecution is<\/p>\n<p>only under Section 138 of the N.I Act.   I am, in these circumstances,<\/p>\n<p>satisfied   that   the   petitioner     can   certainly   apply   before   the   learned<\/p>\n<p>Magistrate   to   seek     exemption   from   personal   appearance.     His<\/p>\n<p>personal   appearance   need   not   be  insisted   by   the  learned  Magistrate<\/p>\n<p>unless progress of the case demands such course.<\/p>\n<p>         5.
