ASHA DEVI W\/O SRI GULAB CHAND SAH R\/O VILL\n           LAURH, P.S.SUPAUL, DISTT-SUPAUL\n                               -----------\n<\/pre>\n<p>02.   26.11.2010              Heard learned counsel for the petitioner, for<\/p>\n<p>                    the State and as also for the private respondent no.9.<\/p>\n<p>                              The petitioner is aggrieved by the order of<\/p>\n<p>                    the Commissioner dated 15.12.2009 in Case No. 16 of<\/p>\n<p>                    2009, preferred by respondent no.9, by which he has<\/p>\n<p>                    upset the order of the District Magistrate dated<\/p>\n<p>                    6.6.2008 holding in favour of petitioner and against<\/p>\n<p>                    the respondent no.9.\n<\/p>\n<p>                              Learned counsel for the petitioner submits<\/p>\n<p>                    that the appellate authority has arrived at the finding<\/p>\n<p>                    that   respondent   no.9   was   not   heard   and   yet<\/p>\n<p>                    proceeding to adjudicate the matters on merits.<\/p>\n<p>                    Properly, he should have set aside the issue and<\/p>\n<p>                    remanded the matter to the District Magistrate.<\/p>\n<p>                    Learned counsel for the respondent no.9 acknowledges<\/p>\n<p>                    and supports the submission to the extent that he was<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>       not heard by the District Magistrate. The order dated<\/p>\n<p>       15.12.2009 and 12.8.2008 are accordingly set aside.<\/p>\n<p>       The matter is remanded to the District Magistrate to<\/p>\n<p>       hear the petitioner and respondent no.9 and others<\/p>\n<p>       concerned afresh and then dispose off the matter by a<\/p>\n<p>       reasoned and speaking order in accordance with law<\/p>\n<p>       within a maximum period of three months from the<\/p>\n<p>       date of receipt\/production of a copy of this order.<\/p>\n<p>                 The application stands disposed.\n<\/p>\n<\/p>\n<pre>P.K.
