                 This civil writ petition has been<\/p>\n
filed under Article 226\/227 of the Constitution<\/p>\n
of India praying for issuance of a writ in the<\/p>\n
nature of mandamus directing the respondents to<\/p>\n
join   the     petitioner        on     the   post     of    Science<\/p>\n
Mistress in District Nawanshahar in pursuance of<\/p>\n
letter dated 10.12.2006 (Annexure P-7).<\/p>\n
                 Learned counsel contends that posts<\/p>\n
of   Science    Mistress         were    advertised         with   the
\n CWP No.16739 of 2007                                        [2]<\/p>\n
qualifications          detailed        in     Annexure           P-1.    The<\/p>\n
petitioner is M.Sc., B.Ed. and applied for the<\/p>\n
same. Learned counsel further contends that after<\/p>\n
the selection process was over, the petitioner<\/p>\n
contacted         the         recruitment            agencies.            The<\/p>\n
petitioner        was        informed        that     she     has        been<\/p>\n
selected. Appointment letter was not issued. On<\/p>\n
further       enquiry,          it      was         disclosed            that<\/p>\n
appointment        letter      was   sent      to     the     office      of<\/p>\n
District      Education         Officer,        Hoshiarpur           which,<\/p>\n
however,     was       not    forwarded       to     the    petitioner\/<\/p>\n
served on the petitioner. The appointment letter<\/p>\n
has been placed on record as Annexure P-7.<\/p>\n
                   Learned counsel for the respondents<\/p>\n
contends that the petitioner was not qualified<\/p>\n
for the post as advertised. Learned counsel has<\/p>\n
further drawn the attention of the Court towards<\/p>\n
Annexure R-1 to contend that it is the admitted<\/p>\n
case of the petitioner that she was not eligible<\/p>\n
for appointment as she approached the Education<\/p>\n
Secretary, Department of School Education, for<\/p>\n
expansion         of     subjects        of         eligibility           for<\/p>\n
selection of Science Master\/ Mistress.<\/p>\n
                   Learned counsel has further drawn<\/p>\n
the attention of the Court towards Annexure R-2\/T<\/p>\n
whereby     the    petitioner        was      informed        about      the
\n CWP No.16739 of 2007                                        [3]<\/p>\n
eligibility criteria\/ qualification required for<\/p>\n
the said post.\n<\/p>\n
                   I have considered the contention of<\/p>\n
the learned counsel and have gone through the<\/p>\n
documents to which reference has been made.<\/p>\n
                   The          Government             of          Punjab,<\/p>\n
Department of School Education, for recruitment<\/p>\n
by way of regular appointment of School Master\/<\/p>\n
Mistress        (Science),             laid          the          following<\/p>\n
qualifications for being eligible:-<\/p>\n
                   “5.   Master\/Mistress (Science)<\/p>\n<\/blockquote>\n
                   1.  B.Sc with BT or B.Ed senor Basic Trained with any
\n                   two of the four subjects in B.Sc namely Physics,
\n                   Chemistry, Botany and Zoology<\/p>\n
                   OR<\/p>\n
                   BA with mathematics “A” course and physical or
\n                   geography and Bt or B.Ed or senior basic trained.”\n<\/p><\/blockquote>\n
                   A     perusal      of    the      above        indicates<\/p>\n
that a candidate is required to pass B.Sc. with<\/p>\n
BT or B.Ed senior basic trained with any two of<\/p>\n
the    four     subjects        in     B.Sc.         namely        Physics,<\/p>\n
Chemistry, Botany and Zoology.<\/p><\/blockquote>\n
                   It is the case of the petitioner<\/p>\n
that     she    has      done      her      M.Sc.,         however,     in<\/p>\n
Bio-Chemistry. It is the admitted case of the<\/p>\n
petitioner that the petitioner has not done M.Sc.<\/p>\n
in any of the two subjects mentioned in Annexure<\/p>\n
P-1,     namely        Physics,        Chemistry,           Botony      and
\n CWP No.16739 of 2007                                            [4]<\/p>\n
Zoology. It seems that in view of these facts,<\/p>\n
the     petitioner           made       a      representation               vide<\/p>\n
Annexure      R-1      dated       24.4.2007,            which        reads    as<\/p>\n
under:-\n<\/p>\n
                           “I beg to say that I have passed my B.Sc from
\n                     Nagpur University Nagpur (M.H) with the subject of
\n                     Chemistry, Bio-Chemistry and Microbiology. I have also
\n                     passed my B.Ed with Teaching of Chemistry and Teaching
\n                     of Biology from above university. I am fully eligible for
\n                     Science Teacher. The similar cases will be in thousands or
\n                     in lacs from various universities.\n<\/p><\/blockquote>\n
                          But in recent recruitment of Science Master by C-
\n                     DAC Mohali only those candidates were selected who
\n                     have passed any two subjects out of only four subjects
\n                     Physics, Chemistry, Botany and Zoology. A large number
\n                     of meritorious candidates were deprived because of this
\n                     narrow eligibility criteria.\n<\/p><\/blockquote>\n
                           Now, I want to request that these four subject based
\n                     Science is a very narrow field for science in the date of
\n                     today. So kindly expanding the field (Subjects) please
\n                     include Bio-chemistry, Micro Biology for the eligibility of
\n                     Science Master\/Mistress. It is the question of future of a
\n                     large number of candidates.”<\/p><\/blockquote>\n
                     I am of the considered view that<\/p>\n
the petitioner, by virtue of Anenxure R-1, admits<\/p>\n
that    she    was     not      eligible           because      she     sought<\/p>\n
expansion        of       subjects            of     eligibility              for<\/p>\n
selection.       The       petitioner              not    having        passed<\/p>\n
B.Sc.\/     M.Sc.        in      two      of        the    four        subjects<\/p>\n
mentioned above and not being eligible has no<\/p>\n
right    to    selection          and     appointment.            I    further<\/p>\n
find    that    the       appointment           letter        was      neither<\/p>\n
issued nor served on the petitioner, therefore,<\/p>\n
no right to appointment is created in favour of<\/p>\n
the petitioner.\n<\/p>\n
