BASANT, J.\n            -------------------------------------------------\n                     B.A. No. 1908 of 2008\n            -------------------------------------------------\n          Dated this the 26th day of March, 2008\n\n                               ORDER\n<\/pre>\n<p>     Application for anticipatory bail.           The petitioners are<\/p>\n<p>accused 1 to 4. The learned counsel for the petitioners, at the<\/p>\n<p>outset, submits that the 3rd petitioner\/the 3rd accused has<\/p>\n<p>subsequently been arrested and enlarged on bail by the<\/p>\n<p>learned Magistrate and, in these circumstances, the petition in<\/p>\n<p>so far as the 3rd petitioner is concerned is not being pressed<\/p>\n<p>now.\n<\/p>\n<p>     2. Altogether, there are 10 accused persons.             Four of<\/p>\n<p>them i.e., the petitioners are named in the F.I.R. There are 6<\/p>\n<p>other accused also who are not named.            The alleged incident<\/p>\n<p>took place on 3\/3\/08 and 5.30 p.m.               On account of prior<\/p>\n<p>animosity, the accused persons, who came in 6 motor-cycles,<\/p>\n<p>allegedly trespassed into the house of the de facto complainant<\/p>\n<p><span class=\"hidden_text\"> B.A. No. 1908 of 2008        -: 2 :-<\/span><\/p>\n<p>and indulged in wanton acts of violence, mischief and damage<\/p>\n<p>was caused to the building.   Injuries, though only simple, were<\/p>\n<p>caused to the victims.      Investigation is in progress.     The<\/p>\n<p>petitioners apprehend imminent arrest.<\/p>\n<p>      3. The learned counsel for the petitioners submits that the<\/p>\n<p>petitioners are absolutely innocent. False allegations are being<\/p>\n<p>raised against them. They may be granted anticipatory bail, it is<\/p>\n<p>prayed.\n<\/p>\n<p>      4. The learned Public Prosecutor opposes the application.<\/p>\n<p>The learned Public Prosecutor submits that all available<\/p>\n<p>indications point to the complicity of the petitioners.    Victims<\/p>\n<p>have suffered injuries.   The premises had suffered damage to<\/p>\n<p>the tune of Rs.6,000\/-.     The scene mahazar prepared bears<\/p>\n<p>eloquent testimony to the nature of the damage caused to the<\/p>\n<p>building.   In any view of the matter, the petitioners may be<\/p>\n<p>directed to surrender before the learned Magistrate and seek<\/p>\n<p>regular bail. There are absolutely no circumstances justifying or<\/p>\n<p>warranting the invocation of the extraordinary equitable<\/p>\n<p>discretion under Sec.438 of the Cr.P.C., submits the learned<\/p>\n<p>Public Prosecutor.\n<\/p>\n<p>      5. Having considered all the relevant inputs, I find merit in<\/p>\n<p>the opposition by the learned Public Prosecutor.    I am satisfied<\/p>\n<p><span class=\"hidden_text\"> B.A. No. 1908 of 2008           -: 3 :-<\/span><\/p>\n<p>that this is a fit case where the petitioner must be directed to<\/p>\n<p>surrender before the Investigating Officer or the learned<\/p>\n<p>Magistrate having jurisdiction and then seek regular bail in the<\/p>\n<p>normal and usual course.\n<\/p>\n<p>     6. In the result, this bail application is dismissed; but with<\/p>\n<p>the observation that if the petitioners surrender before the<\/p>\n<p>Investigating Officer or the learned Magistrate and seek bail,<\/p>\n<p>after giving sufficient prior notice to the Prosecutor in charge of<\/p>\n<p>the case, the learned Magistrate must proceed to pass<\/p>\n<p>appropriate orders on merits and expeditiously.<\/p>\n<p>                                                         Sd\/-\n<\/p>\n<p>\n                                             (R.
