3. After service of notice the owner of the vehicle
\nentered appearance. admitted the accident and the injury
\nsustained by the claimams. He cor1tiended._i:’that he<\/p>\n
obtained a Valid insurance poiicy in respectof _)A[‘1VV”1{“.’2:”‘\\”\u20aciI”ii,.C1’3f”,’<\/p>\n
involved in the accident and;\u00bbrrtherefore Vthde i:1.s];;;r:..n\u00a2er. ‘<\/p>\n
company is liable to pay the cori1pe:nsaVtioCn,_yThe
\nCompany also filed a detaidiedwritteri.sta_t\u00a2me1?it”contesting<\/p>\n
the claim.\n<\/p>\n
4. The Commissioner r_ci{ubb’eci1;r ._”all_ the 4 cases.
\nconducted a  \u00ab._the claimants were<\/p>\n
exaniined.’  have also examined the doctor
\nWho treated have produced 18 documents<\/p>\n
   Ex. P 1 to P 18. On behalf of the
\n”  no evidence was adduced. However by
\nxiparties the insurance policy was marked as
\n  Commissioner on appreciation of the aforesaid<\/p>\n
A  oifahand documentary evidence on record has held that<\/p>\n
C   Rangaswamy ciaimant in Ciairn Petition No.74\/2001<\/p>\n
and Sri Dyamappa claimant in Claim Petition No;
\n76\/ 2001 had sustained simple injuries and  he
\nawarded a sum of Rs.4,000\/~ to each of
\nother two claimants are concerned

 ‘recordf;  has also not taken in to consideration the<\/p>\n
 evidleneeh  the claimants that they were earning more<\/p>\n

 l5~p?cs.2,OOO\/– p.m. only which is also on the lower side and<\/p>\n
\\A\/<\/p>\n
therefore he submits a case is made for enhancement of
\ncompensation.\n<\/p>\n
6. Per contra, Sri L. Sreekanta Rao, 1earne;i.V..C\u00aboVU–nse1
\nappearing for the 2nd respondent Insurance:
\nsubmits that in the absence voferiany
\nhavirlg regard to the fact that:b’:’a117′.A_’the
\nagricultural cookies, the  istvof  the
\nCommissioner was jus_tified””iniVc_:’: ttak\ufb01ingtgit’theirv’:\u00a7income at<\/p>\n
Rs.2.000\/– p.1n. As the; have sustained<\/p>\n
 Rs.4,000\/\u00bb\u00ab to each of them and
\nthe  taro’  are concerned they have
\nsustained  and on the medical evidence and the\n<\/p>\n
-v_is~st,1ed by the doctor, applying the relevant
\n  awarded just. and proper compensation<\/p>\n
V and no” case for enhancement is made out.
\n  We have gone through the award and other<\/p>\n
‘–..na-aierieiis on record. We are satisfied that. the injuries<\/p>\n
sustained by Sri Rangaswamy and Sri Dyamappa are
\nsimple in nature and they were agricultural :__It is
\nnot possible to accept their evidence
\nearning Rs. 150\/ — per day as wageshand
\nbatta and therefore compensation .
\nthat basis. Having regard’to”‘t__he
\nattendant circumstances  after looking
\ninto the legal   in holding the
\ninjuries sustair1K\u00a7’d_’by:’thVe’ ‘   are simple
\nin nature  to each of them is
\njust and’pi;\u00a7;Jer:;:::fi.\u00a7V”Inf*lspo-lfar””‘as’;other two ciaimants are
\nconcerned fracture and admitted to
\nhospital  acceptiiigthe evidence of the doctor, applying
\n  it the Commissioner has awarded
\n  is legitimately due to them. Hence we
\n any justification to enhance such
\n compensation, as what is awarded by the Commissioner is<\/p>\n
 -.lja.sed on legal and medical evidence. We do not see any<\/p>\n

merit in any of these appeals. Hence we pass the
