KRUTI M SHAH for Petitioner(s) : 1, \nMR RJ\nOZA for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/10\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpetitioner by this petition has prayed for the various relief.<br \/>\n\tHowever, upon hearing learned Counsel appearing for the petitioner,<br \/>\n\tit appears that the principal grievance on the part of the<br \/>\n\tpetitioner is that after petitioner shown the willingness of handing<br \/>\n\tover the possession of the premises and desire to get the money<br \/>\n\trealised by the sale of the property, as the bank did not take<br \/>\n\taction well in time, bank should not be permitted to charge interest<br \/>\n\ton the unpaid amount. Therefore, it has been submitted on behalf of<br \/>\n\tthe petitioner that if the said amount of interest after declaration<br \/>\n\tof the account as NPA is excluded, there may be surplus amount<br \/>\n\tavailable with the bank, which the petitioner may receive.\n<\/p>\n<p>Whereas<br \/>\n\ton behalf of the respondent bank, it has been submitted that the<br \/>\n\tactual physical possession is not handed over, but if the petitioner<br \/>\n\thand-overs the actual physical possession, bank will make an attempt<br \/>\n\tto sale the property and at the time of appropriation of the money,<br \/>\n\tthe petitioner may make representation and the bank will consider<br \/>\n\tthe same in accordance with law and also as per the policy<br \/>\n\tprevailing of the bank from time to time.\n<\/p>\n<p>In<br \/>\n\tabove view of the matter, it appear that if the petitioner desirous<br \/>\n\tto hand over the possession of the property to the bank for<br \/>\n\trealisation of the dues under the Securitisation and Reconstruction<br \/>\n\tof Financial Assets and Enforcement of Security Interest Act, 2002<br \/>\n\t(hereinafter referred to as the &#8216;Securitisation Act&#8217;), the same<br \/>\n\tshould encourage by the bank. The learned Counsel appearing for the<br \/>\n\tpetitioner declared before the Court that the petitioner is ready to<br \/>\n\thand over the possession within a period, as may be ordered by this<br \/>\n\tCourt.\n<\/p>\n<p>Hence,<br \/>\n\tit appears that following directions shall meet with the ends of<br \/>\n\tjustice:\n<\/p>\n<p>A)<br \/>\nThe petitioner shall hand over the actual physical possession of the<br \/>\nproperty to the respondent bank within a period of one month i.e. in<br \/>\nany case on or before 10.11.2008.\n<\/p>\n<p>B)<br \/>\nThe bank shall take over the possession after drawing proper<br \/>\nPanchnama.\n<\/p>\n<p>C)<br \/>\nThe bank shall also take immediate steps for disposal of the property<br \/>\nunder the Securitisation  Act, read with the rules and shall complete<br \/>\nthe process within a period of three months from the receipt of the<br \/>\nactual physical possession.\n<\/p>\n<p>D)<br \/>\n At the time when the property is to be sold by the bank and the<br \/>\noffers are to be invited, it would be open to the petitioner to offer<br \/>\nbuyer, if available and who is ready to offer higher price of the<br \/>\nproperty.\n<\/p>\n<p>E)<br \/>\nThe bank shall make an attempt to dispose of the property by<br \/>\nrealising maximum price of the property.\n<\/p>\n<p>F)<br \/>\nAfter process of the sale is completed, within a period of one week<br \/>\nthereafter, it would be open to the petitioner to make detailed<br \/>\nrepresentation to the respondent bank for extending benefit of waiver<br \/>\nof interest, as per the policy of the bank and as per the guideline<br \/>\nof the RBI prevailing from time to time, and the petitioner may also<br \/>\nrequest the bank to consider the relaxation in the interest, if<br \/>\npermissible in law after declaration of the account as NPA.\n<\/p>\n<p>G)<br \/>\nThe bank shall consider the representation of the petitioner in<br \/>\naccordance with law and also as per the prevailing policy of the bank<br \/>\nand guidelines of RBI.\n<\/p>\n<p>H)<br \/>\nThe aforesaid exercise shall be completed within a period of four<br \/>\nweeks from the receipt of such representation. The bank shall<br \/>\ncommunicate its decision by R.P.A.D. Post to the petitioner.\n<\/p>\n<p>I)<br \/>\nAfter the decision of the bank, if the petitioner is aggrieved, the<br \/>\npetitioner may resort to the remedy, as available in law for<br \/>\nchallenging the said action of the bank for appropriation of the<br \/>\namount or for receipt of the surplus amount recovered by the bank<br \/>\nfrom the sale of the property. At that stage the rights and<br \/>\ncontentions of both the sides, shall remain open.\n<\/p>\n<p>The<br \/>\n\tpetition is disposed of in terms of the aforesaid directions. No<br \/>\n\torder as to costs.
