(Oral)\n<\/pre>\n<p>              The petitioner, who was working as Clerk in Branch Office,<\/p>\n<p>Primary Agricultural Cooperative Society, Jhallania and has retired on<\/p>\n<p>29.2.2008 on attaining the age of superannuation, has filed the instant<\/p>\n<p>petition for setting aside the order dated 23.2.2008, whereby the retiral<\/p>\n<p>benefits of the petitioner were withheld in an illegal and arbitrary manner.<\/p>\n<p>              After notice of motion, written statement has not been filed.<\/p>\n<p>However, counsel for the respondents states that all the retiral benefits have<\/p>\n<p>been released to the petitioner on 26.3.2009. Counsel for the petitioner does<\/p>\n<p>not dispute this fact. However, he submits that there was no justification for<\/p>\n<p>making late payment of the retiral benefits, for which the petitioner is<\/p>\n<p>entitled for interest.\n<\/p>\n<p><span class=\"hidden_text\">                   C.W.P. No.3159 of 2008                         -2-<\/span><\/p>\n<p>            After hearing the counsel for the parties, this petition is<\/p>\n<p>disposed of with liberty to the petitioner to make a representation to the<\/p>\n<p>respondents with regard to interest on the delayed payment of retiral<\/p>\n<p>benefits.
