Respondent Nos.4 to 8 are not<br \/>\nnecessary party and therefore, Rule is not also required to be served<br \/>\nupon them.\n<\/p>\n<p>2.\tBy<br \/>\nfiling instant petition under Article 226 of the Constitution of<br \/>\nIndia, the petitioner has prayed to issue writ of Habeas Corpus or in<br \/>\nthe nature of Habeas Corpus or any other appropriate writ, direction<br \/>\nand\/or order directing respondents to produce her daughter &#8211;<br \/>\ncorpus Rekha before this Court, who is in illegal detention of<br \/>\nrespondent No.3 Nayak Ganapatbhai Gangarambhai and handover her<br \/>\ncustody to him.\n<\/p>\n<p>3.\tIt<br \/>\nis averred in the petition by the petitioner that his daughter &#8211;<br \/>\ncorpus Rekha was taken from his residential house by respondent Nos.3<br \/>\nto 8 on 10.8.2010.  The petitioner therefore, has informed PI, Sanand<br \/>\nPolice Station, however, no effective steps are taken nor whereabouts<br \/>\nof corpus Rekha are known to the petitioner.  It is further averred<br \/>\nin the petition that corpus Rekha is illegally detained and confined<br \/>\nby respondent No.3 against her wish and desire.  The petitioner has<br \/>\ntherefore, filed the present petition and prayed for the relief to<br \/>\nwhich the reference is made in the earlier paragraph of the judgment.\n<\/p>\n<p>4.\tThis<br \/>\nCourt vide order dated 14.10.2010 issued Notice to respondent Nos.1,2<br \/>\nand 3 only, which was made returnable on 28.10.2010 on condition that<br \/>\nthe petitioner shall deposit Rs.10,000\/- as a cost, to show his bona<br \/>\nfide, with the Registry of this Court on or before 18.10.2010.  On<br \/>\nreturnable date, the corpus could not be found out.  Therefore, time<br \/>\nwas sought for and the matter was adjourned to 25.11.2010 i.e. today.\n<\/p>\n<p>5.\tToday<br \/>\nwhen the matter is called out, Mr. Dabhi, learned APP, upon<br \/>\ninstructions received from Mr. Somabhai, ASI, Sanand Police Station<br \/>\nwho is personally present in the Court, states that corpus Rekhaben<br \/>\nis found out from village Bhiapur, Tal &amp; Dist: Nagpur,<br \/>\nMaharashtra, who was in illegal detention of respondent No.3 &#8211;  Nayak<br \/>\nGanapatbhai Gangarambhai, who is also present in the Court.  He has<br \/>\nbrought the corpus with the assistance of woman constable and seeks<br \/>\npermission to produce corpus Rekhaben before the Court. We have<br \/>\npermitted to produce corpus Rekha before us.\n<\/p>\n<p>6.\tWe<br \/>\nhave ascertained the wish and willingness of the corpus Rekha and<br \/>\nalso inquired whether she was in illegal detention of respondent No.3<br \/>\nNayak Ganapatbhai Gangarambhai.  She has unequivocally stated before<br \/>\nus that she was in illegal detention of respondent No.3 &#8211;  Nayak<br \/>\nGanapatbhai Gangarambhai, who had forcibly kidnapped her against her<br \/>\nwill from her village Rasulpura, Tal: Sanand, Dist: Ahmedabad and<br \/>\ntaken to Maharashtra and also forcibly married her in a temple and<br \/>\nthe said marriage is also registered before the Sub Registrar of<br \/>\nMarriage, Chimur Gram Panchayat, Dist: Nagpur, Maharashtra after<br \/>\nobtaining her signature forcibly.  She therefore, wants to go with<br \/>\nher father &#8211; petitioner.\n<\/p>\n<p>7.\tSo<br \/>\nfar as her age is concerned, admittedly, on the date of incident, she<br \/>\nwas minor less than 18 years, of course, today she is above 18 years.<br \/>\n Therefore, she is sui juris and no fetters can be placed upon her<br \/>\nchoice of the person with whom she has to stay.  As she has<br \/>\ncategorically stated before us that respondent No.3 has not only<br \/>\nforcibly kidnapped her, but also married against her will and wish<br \/>\nand the said marriage is performed in temple and also is registered<br \/>\nbefore the Sub Registrar of Marriage forcibly and therefore, she<br \/>\nwants to go with the petitioner &#8211; her father.  We have<br \/>\ntherefore, permitted her to go with her father &#8211; petitioner.\n<\/p>\n<p>8.\tFor<br \/>\nthe foregoing reasons, this petition succeeds and accordingly it is<br \/>\nallowed.  Rule is made absolute.
