WADHWA.\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.  We have  heard learned  counsel for the<br \/>\nparties.\n<\/p>\n<p>     This appeal  by special  leave arises from the judgment<br \/>\nand order  of the  High Court  of  Punjab  &amp;  Haryana  dated<br \/>\n19.12.1996 made in CWP No. 18180 of 1996.\n<\/p>\n<p>     The admitted  position is\tthat pursuant to the charge-<br \/>\nsheet  dated   1.6.1996\t issued\t  to  the   respondent,\t  on<br \/>\n20.11.1996, the\t Enquiry officer  rejected permission to the<br \/>\nrespondent to  engage Shri  Kamal Kumar, a retired employee,<br \/>\nas a  defence assistant\t in the\t enquiry. The respondent was<br \/>\nasked to  appear either\t in person or through an employee of<br \/>\nthe  Corporation  or  a\t Central  Government  or  the  State<br \/>\nGovernment employee  to defend\thimself, The  respondent did<br \/>\nnot appear.  On the  other hand, he filed a writ petition in<br \/>\nthe High  Court\t contending  that  he  is  entitled  to\t the<br \/>\nassistance of  a retired employee of the Food Corporation of<br \/>\nIndia.\tThe  High  Court  allowed  the\twrit  petition\twith<br \/>\ndirection to  the corporation  to allow\t the  respondent  to<br \/>\nengage the  retired  employee  as  defence  assistance.\t The<br \/>\nquestion is:  whether the  High Court is right in giving the<br \/>\ndirection? It  is true\tthat in\t an enquiry conducted by the<br \/>\nDepartment, the\t delinquent  is\t entitled  to  a  reasonable<br \/>\nopportunity to\tdefend himself\tincluding the  assistance of<br \/>\nthe employee of the Corporation or of the Central Government<br \/>\nor the\tState Government  employee. Rule  58(8) of  the Food<br \/>\nCorporation of\tIndia Staff Regulations, which postulates as<br \/>\nunder:\n<\/p>\n<blockquote><p>     &#8220;58(8) The\t employee may  take  the<br \/>\n     assistant of  any other employee of<br \/>\n     the Corporation  or  any  State  or<br \/>\n     Central  Government   employee   to<br \/>\n     present the case on his behalf, but<br \/>\n     may not engage a legal practitioner<br \/>\n     for   the\t  purpose   unless   the<br \/>\n     Presenting Officer appointed by the<br \/>\n     Disciplinary authority  is a  legal<br \/>\n     practitioner, or,\tthe disciplinary<br \/>\n     authority,\t having\t regard\t to  the<br \/>\n     circumstances  of\t the  case,   so<br \/>\n     permits.&#8221;<\/p><\/blockquote>\n<p>     A\treading\t thereof  would\t clearly  indicate  that  an<br \/>\nemployee is  entitled to  an opportunity  to defend  himself<br \/>\neither in  person or  through an employee of the Corporation<br \/>\nor  of\tthe  Central  Government  of  the  State  Government<br \/>\nemployee, in  the departmental enquiry conducted against the<br \/>\ndelinquent. A  legal practitioner  is prohibited  to  appear<br \/>\nbefore\t the\tDisciplinary\tAuthority.    Under    these<br \/>\ncircumstances, a  direction given by the High Court to allow<br \/>\nthe respondent to take the assistance of a retired employee,<br \/>\nthough he  is not  a legal practitioner who is prohibited to<br \/>\nappear and  assist the\tdelinquent, in\treality\t amounts  to<br \/>\npermitting the\tretired employee  to have  regular practice,<br \/>\nThe High  Court has  committed an  error in  giving  such  a<br \/>\ndirection.\n<\/p>\n<p>     However, It  is stated  that pursuant  to the direction<br \/>\ngiven by  the  High  Court,  the  assistance  of  a  retired<br \/>\nemployee was already given and the enquiry was completed. If<br \/>\nthat is\t so, the  enquiry need not be reopened. In the above<br \/>\nfacts and  circumstances of  the case,\twe do  not  want  to<br \/>\ninterfere with the directions given by the High Court.\n<\/p>\n<p>     The appeal is accordingly allowed.
