Respondent is the original plaintiff.<br \/>\nHe has instituted Civil Suit No.2308 of  1988  before City Civil<br \/>\nCourt, Ahmedabad.  Nearly 20 years after the institution of the said<br \/>\nsuit, the respondent-plaintiff filed application Ex.205 seeking<br \/>\namendment in the plaint.  This application came to be allowed by the<br \/>\nlearned Judge  by the impugned order dated 14.5.08.\n<\/p>\n<p>\tAmendment<br \/>\nis opposed by the petitioners mainly on following grounds:-\n<\/p>\n<p>That<br \/>\n\tthe amendment application was filed belatedly. The suit was filed in<br \/>\n\tthe year 2008. The amendment application was filed in January 2008.<br \/>\n\tIn the meantime, the defendants  had filed written statement and<br \/>\n\ttrial had also commenced.\n<\/p>\n<p>That<br \/>\n\tthe learned Judge allowed the amendment without recording any<br \/>\n\treasons  despite stout opposition from the petitioners.\n<\/p>\n<p>It<br \/>\n\twas further contended that the amendment otherwise also could not<br \/>\n\thave been granted. It was pointed out that in the plaint itself that<br \/>\n\t  the plaintiff had stated that the suit property is of the joint<br \/>\n\townership of the plaintiff and defendant No.1.  Through the<br \/>\n\tamendment, the plaintiff wanted to amend the prayer clause praying<br \/>\n\tinter alia that the property in question was of his exclusive<br \/>\n\townership.  It was thus contended that the nature of the suit<br \/>\n\tcompletely changes with the amendment and such amendment could not<br \/>\n\thave been granted.\n<\/p>\n<p>\tLearned<br \/>\nadvocate  Shri Damani for respondent-original plaintiff, however,<br \/>\nopposed the petition and contended that there is voluminous evidence<br \/>\nto show that the plaintiff was the owner of the property. The<br \/>\ndefendants have no documents or any other proof to show their<br \/>\nownership rights. He submitted that the amendment should be liberally<br \/>\n granted particularly when the suit was instituted prior to the<br \/>\namendment in Civil Procedure Code in 2002.\n<\/p>\n<p>\tHaving<br \/>\nheard the learned advocates appearing for the parties and having<br \/>\nconsidered the  material  on record, I find that the learned Judge<br \/>\ncommitted error in granting the amendment. Upon perusal  of the order<br \/>\nunder challenge, it can be clearly seen that no reasons whatsoever<br \/>\nhave been stated for  accepting such amendment application at such a<br \/>\nbelated stage.  Learned Judge  has also not given any reasons to<br \/>\novercome the opposition of the defendants  that granting of such<br \/>\namendment would change the nature of the suit.  Even otherwise, I<br \/>\nfind that the amendment could not have been permitted.  In the suit,<br \/>\nthe plaintiff had stated, inter alia, that the suit property is  of<br \/>\nthe ownership  of the plaintiff and defendant No.1.  Through the<br \/>\namendment application, a prayer is sought to be added for the<br \/>\ndeclaration that the plaintiff is the exclusive owner of the suit<br \/>\nproperty.  This would certainly change the nature of the suit and the<br \/>\namendment  of such a nature at such a belated stage could not have<br \/>\nbeen granted.\n<\/p>\n<p>\tIn<br \/>\nthe result, the petition is allowed.  The impugned order dated<br \/>\n14.5.2008 is quashed.
