BALASUBRAMANYAN, J.\n<\/p>\n<p>1.\t\tLeave granted.\n<\/p>\n<p>2.\t\tThe appellant was temporarily appointed as an<br \/>\nUpper Division Stenographer on 14.8.1976 on being<br \/>\nsponsored through Employment Exchange.  The appellant<br \/>\nthereafter participated in a direct recruitment process of<br \/>\nUpper Division Stenographers conducted by the Andhra<br \/>\nPradesh Public Service Commission and was selected on<br \/>\n17.1.1979.  He was allotted to the Department of Printing<br \/>\nat Hyderabad.   On the request of the appellant, he was<br \/>\nre-allotted to the Commercial Taxes Department on<br \/>\n25.7.1979 for appointment as Upper Division<br \/>\nStenographer.  He joined the Commercial Taxes<br \/>\nDepartment as Upper Division Stenographer.  On<br \/>\n21.2.1980, the Deputy Commissioner of Commercial<br \/>\nTaxes, Krishna Division, passed an order to the effect that<br \/>\nthe services of the appellant, a temporary Upper Division<br \/>\nStenographer in the office of the Deputy Commissioner<br \/>\n(C.T.), Vijayawada, who was selected and allotted to<br \/>\nKrishna Division for appointment as Upper Division<br \/>\nStenographer by the Andhra Pradesh Public Service<br \/>\nCommission are regularized in the cadre of Upper Division<br \/>\nStenographer with effect from 14.8.1976, the date of his<br \/>\nfirst or temporary appointment, under Rule 23(a) of the<br \/>\nAndhra Pradesh State and Subordinate Service Rules.<br \/>\nBut, it was clarified that his seniority will be decided in<br \/>\ndue course.   It was declared that the appellant had<br \/>\ncompleted his probation satisfactorily in the cadre of<br \/>\nUpper Division Stenographer on the afternoon of<br \/>\n19.8.1978.  The appellant was posted as Senior Assistant<br \/>\n(Upper Division Clerk), which was said to be an equivalent<br \/>\npost to Senior Stenographer (Upper Division<br \/>\nStenographer).\n<\/p>\n<p>3.\t\tA draft seniority list of Upper Division Clerks<br \/>\nwas published and objections were invited.  The appellant<br \/>\nwas shown at Serial No. 60.  Claiming that he was entitled<br \/>\nto be at Serial No. 39 in the light of the order passed<br \/>\nunder Rule 23(a) of the State and Subordinate Service<br \/>\nRules regularizing his service with effect from 14.8.1976,<br \/>\nhe filed an objection and a representation.  Since his<br \/>\nobjection and subsequent representation did not yield<br \/>\nfruitful result, the appellant approached the Andhra<br \/>\nPradesh Administrative Tribunal with a claim numbered<br \/>\nas R.P. No. 3055 of 1987.  Apparently, he did not implead<br \/>\nany of the other Upper Division Clerks who would have<br \/>\nbeen affected if his claim for being ranked at Serial No. 39<br \/>\nwas accepted.  But the Administrative Tribunal without<br \/>\nregard to that fact allowed his application.  A petition for<br \/>\nreconsideration of the question, filed by two persons who<br \/>\nwere affected, was rejected by the Tribunal.  This resulted<br \/>\nin the affected persons, approaching this Court by way of<br \/>\na Petition for Special Leave to Appeal.  This Court by<br \/>\njudgment dated 29.8.1997 in Civil Appeal No. 5890 of<br \/>\n1997, set aside the orders of the Tribunal and remanded<br \/>\nthe claim of the appellant to the Tribunal for being decided<br \/>\nafresh on merits after hearing the aggrieved parties who<br \/>\nwere before this Court.  Thereafter, the Tribunal rejected<br \/>\nthe claim of the appellant mainly on the basis that the<br \/>\nappellant had sought a transfer to the Commercial Taxes<br \/>\nDepartment from the Department to which he was<br \/>\noriginally allotted on selection and had thereby become<br \/>\njunior most in the Department in terms of Rule 16 of the<br \/>\nAndhra Pradesh Ministerial Service Rules.  The Tribunal<br \/>\nalso did not accept the contention of the appellant that his<br \/>\nseniority should be counted from 14.8.1976 in any event<br \/>\nand not from 5.8.1980.  Feeling aggrieved, the appellant<br \/>\napproached the High Court of Andhra Pradesh.  The High<br \/>\nCourt accepted the claim of the appellant to the extent<br \/>\nthat the appellant had to be treated as an Upper Division<br \/>\nClerk with effect from 25.7.1979 as the re-allotment of the<br \/>\nappellant to the Commercial Taxes Department as<br \/>\nProbationer in the cadre of Upper Division Clerks was on<br \/>\n25.7.1979.  But, the High Court also took the view that<br \/>\nsince the appellant had been re-allotted to the Commercial<br \/>\nTaxes Department at his request, in terms of Rule 16 of<br \/>\nthe Andhra Pradesh Ministerial Service Rules, he had to<br \/>\nbe placed as junior-most in the cadre in that Department<br \/>\nin terms of Rule 27(1)(iii) of the Rules.  Feeling aggrieved,<br \/>\nthe appellant has come up to this Court.\n<\/p>\n<p>4.\t\tLearned Senior Counsel for the appellant<br \/>\ncontended that the High Court had wrongly interpreted<br \/>\nRule 27(1) of the Rules.  When the appellant was posted<br \/>\nas Upper Division Clerk, he was entitled to count his<br \/>\nseniority as Upper Division Stenographer by virtue of<br \/>\nG.O.M.S. No. 635 dated 13.9.1979 by which proviso (iv) to<br \/>\nsub-Rule (1) of Rule 27 was substituted.  He also<br \/>\ncontended that Rule 16 of the Andhra Pradesh Ministerial<br \/>\nService Rules had no application in respect of allotment<br \/>\nmade by the Public Service Commission and it applied<br \/>\nonly to cases where after allotment by the Andhra Pradesh<br \/>\nPublic Service Commission, transfers are effected by Unit<br \/>\nOfficers in consultation with each other pursuant to the<br \/>\nrequest made by an employee for transfer from one<br \/>\ndepartmental unit to another departmental unit.  He also<br \/>\nsubmitted that even if Rule 16 is held to be applicable,<br \/>\nwhen he was re-allotted in the year 1979, he was the only<br \/>\nperson holding that post in the cadre and hence his<br \/>\nseniority should be reckoned on that basis.\n<\/p>\n<p>5.\t\tOn behalf of the respondents, it is submitted<br \/>\nthat the Tribunal and the High Court were justified in<br \/>\nholding that the appellant became the junior-most in the<br \/>\ncadre on 25.7.1979 on his re-allotment to the Commercial<br \/>\nTaxes Department at his request and that the order<br \/>\npassed in terms of Rule 23(a) of the Andhra Pradesh State<br \/>\nand Subordinate Service Rules, reserving the fixing of his<br \/>\nseniority to a later date does not enable him to get out of<br \/>\nthe effect of Rule 27(1)(iii) of the Andhra Pradesh<br \/>\nMinisterial Service Rules.  Rule 16(1) also made such a<br \/>\ntransfer subject to Rule 27.  The decision in State of<br \/>\nTamil Nadu &amp; Anr. Vs. E. Paripoornam &amp; Ors. [1992<br \/>\nSupp (1) S.C.C. 420] was relied on to contend that the<br \/>\ntemporary service of the appellant prior to his regular<br \/>\nappointment could not be counted for seniority.  It was<br \/>\nsubmitted that there was no reason to interfere with the<br \/>\ndecision of the High Court.\n<\/p>\n<p>6.\t\tThe High Court has assigned to the appellant<br \/>\nthe date 25.7.1979 in the cadre of Upper Division Clerk.<br \/>\nIn this appeal by the appellant, we do not see any reason<br \/>\nto interfere with that finding.\n<\/p>\n<p>7.\t\tThe order passed in favour of the appellant in<br \/>\nterms of Rule 23(a) of the Andhra Pradesh State and<br \/>\nSubordinate Service Rules specifically leaves open the<br \/>\nquestion of fixing his seniority at a later point of time.  The<br \/>\nargument on behalf of the appellant that Rule 27(1)(iii) of<br \/>\nthe Andhra Pradesh Ministerial Service Rules cannot be<br \/>\napplied to the appellant cannot be accepted.  Rule 16(1) of<br \/>\nthe Andhra Pradesh Ministerial Service Rules specifically<br \/>\nprovides for application of Rule 27.  It is undisputed that<br \/>\nthe appellant, on his selection, was originally allotted to<br \/>\nthe Printing Department.  He sought a re-allotment and<br \/>\nafter eight months, he was  re-allotted to the Commercial<br \/>\nTaxes Department.   In other words, he opted to get<br \/>\nallotted or transferred to the Commercial Taxes<br \/>\nDepartment.  We see no reason to confine the operation of<br \/>\nRule 27(1)(iii) of the Andhra Pradesh Ministerial Service<br \/>\nRules only to cases of transfer at the instance of the Heads<br \/>\nof Department and as not applicable to a re-allotment on<br \/>\nthe basis of a request by a candidate selected by the<br \/>\nPublic Service Commission.  In our view, the High Court<br \/>\nwas justified in holding that Rule 27 of the Andhra<br \/>\nPradesh Ministerial Service Rules applied in the case on<br \/>\nhand and the appellant became the junior-most in his<br \/>\ncadre in the Commercial Taxes Department on his being<br \/>\nre-assigned to the Department on 25.7.1979.  We are<br \/>\ntherefore not satisfied that any ground has been made out<br \/>\nfor interference with the decision of the High Court.\n<\/p>\n<p>8.\t\tIn the light of this, we find no reason to interfere<br \/>\nwith the decision of the High Court.
