Respondents\n\n\nCORAM:       HON'BLE MR.JUSTICE AJAY KUMAR MITTAL\n\nPresent:     Mr.Sant Pal Singh Sidhu, Advocate,\n             for the petitioner.\n\n             Mr.P.S.Thiara, Advocate,\n             for the respondents.\n\n\nAJAY KUMAR MITTAL, J.\n<\/pre>\n<p>             The plaintiff-petitioner has approached this Court under Article<\/p>\n<p>227 of the Constitution of India, for setting aside the order dated 19.8.2006,<\/p>\n<p>passed by the passed by Civil Judge (Senior Division), Ludhiana<\/p>\n<p>(Annexure-P1) whereby the application filed by it for temporary injunction<\/p>\n<p>restraining the respondents from disconnecting the electricity supply to the<\/p>\n<p>meter of the petitioner and also from recovering the amount of penalty from<\/p>\n<p>it was dismissed, and the order dated 26.3.2009 (Annexure P-2) whereby<\/p>\n<p>the District Judge, Ludhiana, on appeal there against affirmed the same.<\/p>\n<p>             In para 6 of its order, the lower Appellate Court while affirming<\/p>\n<p>the order of the trial court recorded as under:\n<\/p>\n<blockquote><p>                          &#8220;I have heard the Ld. Counsel for the parties and I<\/p>\n<p>                          am of the considered opinion that the instant<\/p>\n<p>                          appeal deserves to be dismissed. It is admitted<\/p>\n<p>                          fact   between   the      parties    that   initially   the<br \/>\n<span class=\"hidden_text\"> C.R.No.2934 of 2009                                                     -2-<\/span><\/p>\n<p>                      sanctioned load was extended from 79.847 KW to<\/p>\n<p>                      298.012 KW and the electric connection was<\/p>\n<p>                      converted into L.S. Category. The appellant had<\/p>\n<p>                      approached the Dispute Settlement Committee for<\/p>\n<p>                      the settlement of issues and had deposited 50% of<\/p>\n<p>                      the alleged demand. The argument raised by the<\/p>\n<p>                      appellant that the Dispute Settlement Committee<\/p>\n<p>                      was biased as it comprised of the full time<\/p>\n<p>                      employees of Punjab State Electricity Board holds<\/p>\n<p>                      no ground because the appellant can not be<\/p>\n<p>                      allowed to challenge the constitution of Dispute<\/p>\n<p>                      Settlement Committee after having appeared<\/p>\n<p>                      before the same and having been unsuccessful in<\/p>\n<p>                      getting    favourable   orders   from    the   same.<\/p>\n<p>                      Furthermore, if the appellant had any grievance<\/p>\n<p>                      against the order of the Dispute Settlement<\/p>\n<p>                      Committee, it had the remedy to approach Dispute<\/p>\n<p>                      Settlement Authority, which is appellate authority.<\/p>\n<p>                      Although the civil court jurisdiction is not barred by<\/p>\n<p>                      scheme framed by Punjab State Electricity Board,<\/p>\n<p>                      by composing a Dispute Settlement Committee,<\/p>\n<p>                      yet it does not take away remedy of the Dispute<\/p>\n<p>                      settlement Authority i.e. the Appellate Authority.<\/p>\n<p>                      The applicant is duty bound to make the payment<\/p>\n<p>                      of the alleged demand, if it is proved that he<\/p>\n<p>                      violated   the   Peak   Load     Hour   Restrictions.<\/p>\n<p>                      Therefore there is no prima facie case in its<\/p>\n<p>                      favour. The balance of convenience is also not in<\/p>\n<p>                      favour of the appellant and no irreparable loss<br \/>\n<span class=\"hidden_text\"> C.R.No.2934 of 2009                                                        -3-<\/span><\/p>\n<p>                        would be caused to it, if the injunction is not<\/p>\n<p>                        granted in its favour. If case is finally decided in<\/p>\n<p>                        favour   of   the   applicant\/plaintiff,   the   money<\/p>\n<p>                        deposited by the appellant can be adjusted in the<\/p>\n<p>                        future bills raised by Punjab State Electricity Board<\/p>\n<p>                        for the consumption of electricity by the appellant.<\/p>\n<p>                        The judgment W.B.S.E.B Vs. Faqir Chand Rice<\/p>\n<p>                        Mills and other (supra) relied upon by the<\/p>\n<p>                        appellant lays down that only half the amount<\/p>\n<p>                        should be directed to be deposited in the matters<\/p>\n<p>                        of money claims. In the said judgment, Hon&#8217;ble<\/p>\n<p>                        Supreme Court has infact observed that obligation<\/p>\n<p>                        is cast upon the consumers to pay the amount<\/p>\n<p>                        subject to the determination of controversy in the<\/p>\n<p>                        suit and in the said judgment Hon&#8217;ble Supreme<\/p>\n<p>                        Court directed the consumer of electricity to<\/p>\n<p>                        deposit a sum of Rs.12 lacs within a period of two<\/p>\n<p>                        months. Hence, the said judgment has not laid<\/p>\n<p>                        down the law that only half the amount should be<\/p>\n<p>                        directed to be deposited.      Infact it says that at<\/p>\n<p>                        least half of the amount would be directed to be<\/p>\n<p>                        deposited. Therefore, I find no merit in the appeal<\/p>\n<p>                        and the same is hereby dismissed.           The lower<\/p>\n<p>                        Court file be returned alongwith the copy of this<\/p>\n<p>                        judgment for compliance. The parties are directed<\/p>\n<p>                        to appear before the ld. Trial Court on 21.4.2009.&#8221;<\/p><\/blockquote>\n<p>            In view of the above observations of the courts below and for<\/p>\n<p>the reason that no illegality or perversity could be shown therein by the<\/p>\n<p>learned counsel for the petitioner, this Court does not find any ground to<br \/>\n<span class=\"hidden_text\"> C.R.No.2934 of 2009                                                        -4-<\/span><\/p>\n<p>interfere with the impugned orders in exercise of its jurisdiction under<\/p>\n<p>Article 227 of the Constitution of India.
