Justice P.BHAVADASAN\n\n Dated :22\/02\/2010\n\n O R D E R\n<\/pre>\n<p>                         P.BHAVADASAN, J.\n<\/p>\n<p>                    &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>                        CRP No.351 of 2008\n<\/p>\n<p>                    &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                     Dated 22nd February 2010<\/p>\n<p>                                  Order<\/p>\n<p>            This is a petition, challenging the order of<\/p>\n<p>enhancement of compensation granted in OP(Ele.)<\/p>\n<p>No.104\/99 by the Additional District Court, Alappuzha.<\/p>\n<p>            2. It appears that the respondent before the<\/p>\n<p>Court below, who is the petitioner herein, cut and removed<\/p>\n<p>some trees standing in the property belonging to the<\/p>\n<p>respondents herein for the purpose of drawing a 110 KV<\/p>\n<p>electric line. It is stated that 35 coconut trees and one pala<\/p>\n<p>tree were cut and removed.                      The Board awarded<\/p>\n<p>Rs.60,000\/- as compensation for the trees cut and<\/p>\n<p>removed from the property. The Board did not award any<\/p>\n<p>amount towards diminution in land value.<\/p>\n<p>            3. The petitioner took up the matter before the<\/p>\n<p>District Court as provided under Ss.10 to 16 of the Indian<\/p>\n<p>Telegraph Act r\/w S.51 of the Indian Electricity Act. The<\/p>\n<p><span class=\"hidden_text\">CRP 351\/08                         2<\/span><\/p>\n<p>Court below, relying on the decision reported in <a href=\"\/doc\/452127\/\">Kumba<\/p>\n<p>Amma v. K.S.E.B.<\/a> (2000(1) KLT 542) enhanced the<\/p>\n<p>compensation by Rs.54,000\/- towards diminution in land<\/p>\n<p>value. Thus the respondents were ordered to be paid a<\/p>\n<p>total compensation of Rs.1,14,000\/- with 6% interest from<\/p>\n<p>the date of cutting of trees till realisation. The said order is<\/p>\n<p>assailed in this petition.\n<\/p>\n<p>           4. The learned counsel for the petitioner<\/p>\n<p>canvassed two points for consideration. It was pointed out<\/p>\n<p>that the enhancement made by the order relying on Kumba<\/p>\n<p>Amma&#8217;s case (supra) was not sustainable since the said<\/p>\n<p>decision has already been reversed and it is no longer<\/p>\n<p>good law. It is also pointed out that no Commission was<\/p>\n<p>taken out and therefore, no evidence regarding the actual<\/p>\n<p>extent of property was available.\n<\/p>\n<p>           5. Though there is some substance in the above<\/p>\n<p>contention, one must notice that the present proceedings<\/p>\n<p>were initiated in the year 1999. 11 years have elapsed. The<\/p>\n<p><span class=\"hidden_text\">CRP 351\/08                      3<\/span><\/p>\n<p>Court below relied on a decision which was then in force<\/p>\n<p>and awarded the compensation. May be it is slightly on the<\/p>\n<p>higher side. But, merely because the decision relied on by<\/p>\n<p>the Court has been reversed, it is not proper to set aside<\/p>\n<p>the order granting enhanced compensation.         One must<\/p>\n<p>remember that the petitioner has lost considerable income<\/p>\n<p>in that regard. So, I feel that it is not proper to interfere<\/p>\n<p>with the order enhancing the compensation, at this<\/p>\n<p>juncture, also considering the drop in money value.<\/p>\n<p>           6. As far the diminution in land value is<\/p>\n<p>concerned, though there was no commission taken in the<\/p>\n<p>case, the Board must be having the necessary details,<\/p>\n<p>which would show the extent of property affected. The<\/p>\n<p>Court below, after evaluating the extent, has enhanced the<\/p>\n<p>amount by Rs.54,000\/-, which is only just and proper. Of<\/p>\n<p>course, the Court below has observed that there is some<\/p>\n<p>difference between the land of the petitioner and the land<\/p>\n<p>for which value was assessed @ Rs.16,000\/-. Whatever<\/p>\n<p>that be, the enhancement made is only just and<\/p>\n<p><span class=\"hidden_text\">CRP 351\/08                      4<\/span><\/p>\n<p>reasonable.\n<\/p>\n<p>           7. Considering the above facts, it is felt that no<\/p>\n<p>grounds are made out warranting interference with the<\/p>\n<p>order of the Court below especially when future interest<\/p>\n<p>awarded is only @ 6%.
