Justice K.T.SANKARAN\n\n Dated :05\/02\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n                  ---------------------------------------------\n                     W.P.(C).No.3796 of 2009\n                  ---------------------------------------------\n             Dated this the 5th day of February, 2009\n\n\n\n                              JUDGMENT\n<\/pre>\n<p>      The petitioner was appointed as Full Time Menial in<\/p>\n<p>T.M.V.H.S. School, Perimpilavu as per Ext.P2 appointment order<\/p>\n<p>dated 4.7.2005.    The said appointment was approved by the<\/p>\n<p>District Educational Officer. It is stated that while continuing his<\/p>\n<p>service as Full Time Menial, the petitioner passed the Kerala<\/p>\n<p>Government Certificate Examination in Fine Arts on 29.7.2008<\/p>\n<p>as evidenced by Ext.P3 certificate. The petitioner contends that<\/p>\n<p>with effect from that date, he is fully qualified to be appointed as<\/p>\n<p>Drawing Teacher in accordance with the qualification prescribed<\/p>\n<p>under Chapter XXXI of the Kerala Education Rules. A regular<\/p>\n<p>vacancy of Drawing Teacher arose in the school on 1.4.2008 due<\/p>\n<p>to the retirement of a Drawing Teacher. The Manager appointed<\/p>\n<p>the 5th respondent as Drawing Teacher on 14.7.2008 in that<\/p>\n<p>vacancy.    Since the appointment was made only after the<\/p>\n<p>commencement of the academic year, the appointment of the<\/p>\n<p>fifth respondent was approved only on daily wage basis. After<\/p>\n<p><span class=\"hidden_text\">WPC No.3796\/2009                 2<\/span><\/p>\n<p>the appointment of the fifth respondent, it is stated that the<\/p>\n<p>petitioner got qualified on 29.7.2008. The case of the petitioner<\/p>\n<p>is that he is a Rule 43 claimant for being appointed as Drawing<\/p>\n<p>Teacher in preference to the 5th respondent. Pointing out these<\/p>\n<p>facts, the petitioner filed a representation dated 22.10.2008<\/p>\n<p>before the Director of Public Instruction. As per the order in<\/p>\n<p>W.P.(C) No.32110\/08, the Director of Public Instruction was<\/p>\n<p>directed to consider and dispose of the said representation. As<\/p>\n<p>per Ext.P7 order dated 8.1.2009, the Director of Public<\/p>\n<p>Instruction rejected the representation submitted by the<\/p>\n<p>petitioner and upheld the approval of the appointment of the<\/p>\n<p>fifth respondent. Challenging Ext.P7 order, the petitioner has<\/p>\n<p>filed Ext.P8 Revision before the Government. Ext.P8 Revision is<\/p>\n<p>pending disposal.\n<\/p>\n<p>      2.   The reliefs prayed for by the petitioner in the Writ<\/p>\n<p>Petition are the following:\n<\/p>\n<blockquote><p>      &#8220;(i) issue a writ of certiorari or any other<br \/>\n           appropriate writ, direction or order calling for<br \/>\n           the records leading to Exts.P6 and P7 and<br \/>\n           quashing the same.\n<\/p><\/blockquote>\n<blockquote><p>      (ii) issue a writ of mandamus or any other<br \/>\n           appropriate writ, direction or order directing<br \/>\n           the first respondent to consider and pass orders<\/p>\n<p><span class=\"hidden_text\">WPC No.3796\/2009                 3<\/span><\/p>\n<p>            on Ext.P8 revision petition filed by the<br \/>\n            petitioner   forthwith   after   affording    an<br \/>\n            opportunity of being heard to the petitioner and<br \/>\n            respondents 4 and 5.\n<\/p><\/blockquote>\n<blockquote><p>      (iii) issue a writ of mandamus or any other<br \/>\n            appropriate writ, direction or order directing<br \/>\n            the fourth respondent to promote the petitioner<br \/>\n            as Drawing Teacher with effect from 1.8.2008.<\/p>\n<\/blockquote>\n<blockquote><p>      (iv) and grant such other and further reliefs as this<br \/>\n            Hon&#8217;ble Court may deem fit and proper in the<br \/>\n            circumstances of the case including costs.&#8221;<\/p><\/blockquote>\n<p>       3. The learned counsel for the petitioner submits that for<\/p>\n<p>the present, the petitioner would be satisfied, if relief No.(ii) is<\/p>\n<p>granted. The learned Government Pleader submitted that Ext.P8<\/p>\n<p>Revision would be disposed of without delay.<\/p>\n<p>      4.    In the facts and circumstances of the case, the Writ<\/p>\n<p>Petition is disposed of as follows:\n<\/p>\n<blockquote><p>      (i)   The first respondent shall consider and dispose<\/p>\n<p>            of   Ext.P8   Revision  dated    20.1.2009,    as<\/p>\n<p>            expeditiously as possible and at any rate within<\/p>\n<p>            a period of three months from the date of<\/p>\n<p>            receipt of a copy of the judgment, after<\/p>\n<p>            affording an opportunity of being heard to the<\/p>\n<p>            petitioner,  the    Manager    and    the    fifth<\/p>\n<p><span class=\"hidden_text\">WPC No.3796\/2009                 4<\/span><\/p>\n<p>           respondent.\n<\/p><\/blockquote>\n<blockquote><p>    (ii)   The petitioner shall produce certified copy of<\/p>\n<p>           the judgment and a copy of the Writ Petition<\/p>\n<p>           before the first respondent.\n<\/p><\/blockquote>\n<blockquote><p>    (iii) The petitioner shall send copy of the judgment<\/p>\n<p>           and a copy of the Writ Petition to respondents 4<\/p>\n<p>           and 5 separately by registered post and shall<\/p>\n<p>           produce    proof    thereof  before   the  first<\/p>\n<p>           respondent.<\/p><\/blockquote>\n<p>                                            K.T.SANKARAN,<br \/>\n                                                JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Soman Sam T vs State Of Kerala on 5 February, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 3796 of 2009(B) 1.
