D.D.C.,Azamgarh And\nOthers\nPetitioner Counsel :- Ram Niwas Singh,Vinay Kumar Singh\nChandel\nRespondent Counsel :- C.S.C.,Anuj Kumar,Sanjay\nK.Srivastava,Santosh Srivastava\n\nHon'ble Mrs. Poonam Srivastav,J.\n<\/pre>\n<p>Instant writ petition has been filed challenging the Order<br \/>\ndated 02.11.2002 annexure 1 passed by the Deputy<br \/>\nDirector Consolidation in Case No. 50 under Section 48(3) of<br \/>\nU.P. Consolidation of Holdings Act, Raghoraj Singh Versus<br \/>\nState. The disputed land is situated in Village Ahibaranpur,<br \/>\nPargana Nizamabad, Tehsil Sadar, District Azamgarh, which<br \/>\nwas notified for consolidation operation for the first time in<br \/>\nthe year 1955. An Order was passed on 30.12.1959 and<br \/>\nRaghoraj Singh was declared as Sirdar and the entry in<br \/>\nfavour of Gaon Sabha was expunged. However,<br \/>\nAmaldaramad of the Order of the Settlement Officer<br \/>\nConsolidation dated 30.12.1959 was not carried out in the<br \/>\nconsolidation records and the village was denotified under<br \/>\nSection 52 of the U.P. Consolidation of Holdings Act.<br \/>\nRaghoraj Singh preferred an application for Amaldaramad of<br \/>\nthe Order of the Settlement Officer Consolidation dated<br \/>\n30.12.1959. Report was called for and the Consolidation<br \/>\nOfficer submitted his report dated 06.04.1980, copy of which<br \/>\nis annexed as annexure 2. This report was forwarded by the<br \/>\nSettlement Officer Consolidation to the Deputy Director<br \/>\nConsolidation and the said report was approved vide Order<br \/>\ndated 24.04.1980 and the proposal of the S.O.C. for<br \/>\nAmaldaramad dated 30.12.1959 was carried out. A copy of<br \/>\nOrder dated 24.04.1980 is annexed as annexure 3.\n<\/p>\n<p>Subsequently, entries were also made in Khatauni of 1388<br \/>\nFasli to 1393 Fasli of village Ahibaranpur over Khata No. 43.<br \/>\nThe State Government made another notification under<br \/>\nSection 4A of U.P. Consolidation of Holdings Act notifying<br \/>\nthe village for the consolidation operation with effect from<br \/>\n17.04.1981. Proceeding under Section 122 B of U.P.<br \/>\n Zamindari Abolition and Land Reforms Act. 1950 and Rule<br \/>\n115 C of the Rules framed under the said Act were initiated<br \/>\nagainst Raghoraj Singh in respect of the land in dispute but<br \/>\nthe said proceedings were dropped by Order of the Assistant<br \/>\nCollector\/Tehsildar Sadar, Azamgarh dated 03.05.1985,<br \/>\nsince fresh consolidation had commenced. Consequently,<br \/>\nname of Raghoraj Singh could not be recorded in the<br \/>\nRevenue record and he died leaving the petitioners as his<br \/>\nheir. After death of Raghoraj Singh, the petitioners came to<br \/>\nknow at a subsequent stage that their names are not<br \/>\nrecorded over the land in question. An application was filed<br \/>\non 15.05.1998 before the District Deputy Director<br \/>\nConsolidation, Azamgarh. On receipt of the aforesaid<br \/>\napplication, the S.O.C.\/Consolidation Officer was directed to<br \/>\nenquire the matter and report be submitted on 19.05.1998.\n<\/p>\n<p>Report     was     submitted    on    31.08.1998    with    a<br \/>\nrecommendation that a dispute in respect of only a part of<br \/>\nthe land is pending. Copy of the report is annexed as<br \/>\nannexure 8. The Consolidation Officer requested the District<br \/>\nGovernment Counsel Revenue, Azamgarh to give his<br \/>\nopinion in this matter vide letter dated 23.02.2000. Original<br \/>\nrecords were sent to him. The Deputy Director Consolidation<br \/>\nRevenue after examining the entire record arrived at a<br \/>\nconclusion that in the previous consolidation proceedings<br \/>\nRaghoraj Singh was declared to be the owner in possession.<br \/>\nIncidentally, a second consolidation has commenced and<br \/>\nthe name of the petitioners have not been entered so far.<br \/>\nThe Consolidation Officer had raised a baseless doubt<br \/>\nwhereas legally the name of the petitioner is liable to be<br \/>\nrecorded till the order of Deputy Director of Consolidation<br \/>\nduring the first consolidation proceedings is not challenged<br \/>\nand quashed. Letter of the D.G.C. Revenue dated<br \/>\n31.03.2000 is annexure 8 to the writ petition. The<br \/>\nConsolidation Officer submitted his report on 21.07.2000 to<br \/>\nthe Deputy Director Consolidation seeking permission to<br \/>\nincorporate the order of Settlement Officer Consolidation<br \/>\ndated 30.12.1959. However, instead of granting permission<br \/>\nto abide by the opinion of the D.G.C. Revenue and the<br \/>\nrecommendation of the Consolidation Officer, a reference<br \/>\nunder Section 48(3) of C.H. Act Raghoraj Singh Versus<br \/>\nState was made. The petitioners submitted all the<br \/>\ndocuments and the necessary evidence staking their rightful<br \/>\nclaim. Reference was preferred to respondent no. 1 District<br \/>\nDeputy Director Consolidation, Azamgarh, which was<br \/>\nrejected by means of the impugned order. The ground of<br \/>\n rejection is that the land in question is a public utility land<br \/>\nand therefore the petitioners can not be recorded.\n<\/p>\n<p>Gaon Sabha has filed its counter affidavit and has only tried<br \/>\nto reiterate what the respondent no. 1 has stated in his<br \/>\norder. Though, counter affidavit has been filed but it has<br \/>\nfailed to substantiate that the land in question is for public<br \/>\nutility within the meaning of Section 132 of U.P. Zamindari<br \/>\nAbolition and Land Reforms Act, 1950. In fact, no<br \/>\nappropriate reply has been given to the various questions<br \/>\nraised in the writ petition.\n<\/p>\n<p>Considered arguments of learned counsel and after going<br \/>\nthrough the entire record, it is apparent that the land in<br \/>\ndispute was recorded as Sirdar of Raghoraj Singh,<br \/>\npredecessor in interest of the petitioner and never land of<br \/>\npublic utility and the findings to the said effect is without any<br \/>\nbasis and it is apparently to sidetrack the claim of the<br \/>\npetitioners. The proceedings under Section 122B of U.P.<br \/>\nZamindar Abolition and Land Reforms Act and Rule 115C of<br \/>\nthe Rules framed thereunder were initiated but they were<br \/>\ndropped and Raghoraj Singh was declared Sirdar of the land<br \/>\nin dispute by the earlier consolidation Courts. Gaon Sabha<br \/>\nhad full knowledge about the order of the Consolidation<br \/>\nCourts but did not challenge the said order before any<br \/>\ncompetent court of law. The order dated 30.12.1959 is<br \/>\nannexed along with rejoinder affidavit and the said order has<br \/>\nnot been set aside till date and therefore no adverse view<br \/>\ncan be taken other than what was decided by the Settlement<br \/>\nOfficer Consolidation in its order dated 30.12.1959. The<br \/>\nDeputy Director Consolidation completely erred in law in<br \/>\nmaking reference and forwarded it to the respondent no. 1<br \/>\nwithout any reason. In fact, it was an uncalled for exercise.<br \/>\nRaghoraj Singh, predecessor in interest of the petitioner was<br \/>\ndirected to be recorded as Sirdar. The Deputy Director<br \/>\nConsolidation carved out an absolutely different case and<br \/>\ndeprived the petitioner of their valid rights. Gaon Sabha<br \/>\nbecame alive only when the second consolidation<br \/>\nproceedings commenced and the petitioners tried to get their<br \/>\nname entered into the revenue record on the basis of<br \/>\nprevious proceedings. Objections were preferred, the only<br \/>\nbasis to arrive at a conclusion against the petitioner is that<br \/>\nthe land in question is a public utility land whereas nothing is<br \/>\non record to substantiate this fact and therefore the disputed<br \/>\nland can not fall within the ambit of Section 132 of U.P.<br \/>\n Zamindari Abolition and Land Reforms Act.\n<\/p>\n<p>In the aforesaid facts and circumstances, the claim of the<br \/>\nGaon Sabha is without any basis. The order passed by<br \/>\nrespondent no. 1 is set aside.
