SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/04\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>RULE.\n<\/p>\n<p>\tMs.Sangeeta Vishen, learned Assistant Government Pleader waives the<br \/>\n\tservice of notice of rule on behalf of the respondent Nos.1 and 2<br \/>\n\tState.\n<\/p>\n<p>With<br \/>\n\tthe consent of the learned advocates appearing on behalf of the<br \/>\n\trespective parties, present application is  taken up for final<br \/>\n\thearing today.\n<\/p>\n<p>In<br \/>\n\tthe present application, the applicant has  prayed for an order to<br \/>\n\textend the date i.e.30\/4\/2010 as stated in the judgement and order<br \/>\n\tdtd.30\/6\/2009 passed by this Court in Special<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters,  and to continue them as ad-hoc on the same terms and<br \/>\n\tconditions as ordered by this Court vide aforesaid judgement and<br \/>\n\torder dtd.30\/6\/2009, till 31\/12\/2010 or  till the regularly selected<br \/>\n\tcandidates from GPSC are available.\n<\/p>\n<p>\tMr.S.I.Nanavati,<br \/>\n\tlearned senior advocate appearing on behalf of the applicant does<br \/>\n\tnot press the rest of the reliefs prayed in the present application<br \/>\n\texcept  the aforesaid prayer\/relief. Mr.S.I.Nanavati, learned senior<br \/>\n\tadvocate appearing on behalf of the applicant has also declared at<br \/>\n\tthe bar that the applicant has not initiated any proceedings before<br \/>\n\tthis Court and\/or any other Court for the relief sought in the<br \/>\n\tpresent application.\n<\/p>\n<p>Mr.S.I.\n<\/p>\n<p>\tNanavati, learned senior advocate appearing on behalf of the<br \/>\n\tapplicant has stated at the bar that the applicant be continued on<br \/>\n\tad-hoc on the same terms and conditions as per the judgement and<br \/>\n\torder  dtd.30\/6\/2009 passed by this Court in Special<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters, more particularly para 19 of the aforesaid judgement and<br \/>\n\torder dtd.30\/6\/2009 and the applicant shall not raise any grievance<br \/>\n\tin future.\n<\/p>\n<p>Having<br \/>\n\theard Mr.S.I. Nanavati, learned senior advocate appearing on behalf<br \/>\n\tof the applicant and  Mr.Kamal Trivedi, learned Advocate General<br \/>\n\tappearing on behalf of the respondent Nos.1 and 2   State  and<br \/>\n\tconsidering the judgement and order dtd.30\/6\/2009 passed by this<br \/>\n\tCourt in Special<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters and subsequent order dtd.28\/1\/2010 passed by this Court in<br \/>\n\tCivil<br \/>\n\tApplication No. 13093 of 2009, by which the State<br \/>\n\tGovernment has been granted further time to make appointment of<br \/>\n\tlecturers on regular basis in the Government Engineering and<br \/>\n\tPolytechnic Colleges in the State of Gujarat on or before<br \/>\n\t31\/12\/2010, the prayer of the applicant herein to continue her as<br \/>\n\tad-hoc on the same terms and conditions as per the judgement and<br \/>\n\torder  dtd.30\/6\/2009 passed by this Court in Special<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters till 31\/12\/2010 and\/or till regularly GPSC selected<br \/>\n\tcandidates  are available, can be considered, otherwise there will<br \/>\n\tbe chaos and vacuum, which will not be in the interest of the<br \/>\n\tstudents and education, as observed in the earlier judgement and<br \/>\n\torder  dtd.30\/6\/2009 passed by this Court in Special<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances and for the reasons stated above, present<br \/>\n\tapplication is allowed to the extent that the applicant be continued<br \/>\n\tas ad-hoc lecturers or the post held by her on ad-hoc on the same<br \/>\n\tterms and conditions as per the judgement and order dtd.30\/6\/2009<br \/>\n\tpassed by this Court in Special<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters, till 31\/12\/2010 or till the regularly GPSC selected and<br \/>\n\tappointed candidates are available, whichever is earlier. Present<br \/>\n\tapplication is accordingly allowed to the aforesaid extent only.<br \/>\n\tRule is made absolute to the aforesaid extent only.
