Civil Application No. 369\/2005 and it is<br \/>\n\talso stated in the petition that there is also breach of the<br \/>\n\tdeclaration made in the proceedings of Appeal From Order No.<br \/>\n\t328\/1994 which came to be disposed of by this Court vide order dated<br \/>\n\t24.10.1994.\n<\/p>\n<p>Heard<br \/>\n\tMs. Contractor for Mr. Nanavati for the petitioner and Mr. Gupta for<br \/>\n\tthe respondents.\n<\/p>\n<p>It<br \/>\n\tappears that after the order dated 24.10.1994 passed by this Court<br \/>\n\tin Appeal From Order No. 328\/1994, the construction has been<br \/>\n\tdemolished as stated by the learned Counsel for the petitioner in<br \/>\n\tthe year 2005. Thereafter, the petitioner did prefer Contempt<br \/>\n\tApplication No. 369\/2005 on the premise that the action was to be<br \/>\n\ttaken under Gujarat Public Premises(Eviction of Unauthorized<br \/>\n\tOccupants) Act, 1972 and the said declaration was not complied with.<br \/>\n\tIt appears that in the said proceedings ultimately the petitioner<br \/>\n\twas satisfied with the declaration on the part of the respondents to<br \/>\n\tconsider the representation and to take appropriate decision. It is<br \/>\n\tan admitted position that thereafter, the representation has been<br \/>\n\tconsidered by the respondents and order dated 9.10.2007 has been<br \/>\n\tpassed. The ground for non-regularization of alleged construction is<br \/>\n\tthat it was falling in the margin area.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, as such when the decision is already taken, it<br \/>\n\tcannot be said that there is any breach of the declaration made in<br \/>\n\tthe order dated 24.7.2007 in the proceedings of Misc. Civil<br \/>\n\tApplication No. 369\/2005. If the petitioner is aggrieved by the<br \/>\n\tdecision of the respondents, the petitioner may resort to<br \/>\n\tappropriate remedy as may be available in law.\n<\/p>\n<p>Learned<br \/>\n\tCounsel for the petitioner attempted to submit that public<br \/>\n\tadvertisement was given on 6.3.2002 for regularization of all<br \/>\n\tillegal construction by GIDC and therefore, the petitioner having<br \/>\n\tacted upon the same and the respondents having made declaration in<br \/>\n\tthe earlier Contempt proceedings,  if there is non-regularization of<br \/>\n\tthe construction which was made by the petitioner, it can be said<br \/>\n\tthat there is defiance. We are afraid that such contention can be<br \/>\n\taccepted when it is not expressly stated in the order. Further<br \/>\n\tregularization, even if to be considered, has to be as per the<br \/>\n\tpolicy. In any case, while sitting in Contempt jurisdiction, we<br \/>\n\twould not examine the validity of the order dated 4.10.2007 nor it<br \/>\n\tis required for us, more particularly, when the declaration was only<br \/>\n\tto consider the representation and to decide the same,  which has<br \/>\n\tbeen done in the present case and hence the attempt on part of the<br \/>\n\tlearned Counsel for the petitioner cannot be countenanced.\n<\/p>\n<p>In<br \/>\n\tview of the above, the present application is disposed of<br \/>\n\taccordingly.\n<\/p>\n<p>It<br \/>\n\tis clarified that in the event challenge is made to the order passed<br \/>\n\tby GIDC, any observations made by this Court shall not prejudice the<br \/>\n\trights of either sides in such proceedings.\n<\/p>\n<p>(Jayant<br \/>\nPatel,J.)<\/p>\n<p>(Akil<br \/>\nKureshi,J.)<\/p>\n<p>(raghu)<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Nilesh vs Gujarat on 23 June, 2008 Bench: Jayant Patel Kureshi, Akil Kureshi MCA\/922\/2008 4\/ 4 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD MISC.CIVIL APPLICATION &#8211;
