No. 58 OF 2008\n                -----------------------------------------------\n            Dated this the 23rd day of October, 2008\n\n                                O R D E R\n<\/pre>\n<p>      The petitioner is the accused in a prosecution under Section<\/p>\n<p>138     of  the       Negotiable          Instruments          Act.   The<\/p>\n<p>respondent\/complainant had filed a complaint before the Judicial<\/p>\n<p>First Class Magistrate Court-I, Kollam and cognizance has been<\/p>\n<p>taken.   The cheque is drawn on the Andra Bank, Ernakulam<\/p>\n<p>branch. According to the petitioner the complainant resides at<\/p>\n<p>Ernakulam.    He had presented the cheque for encashment<\/p>\n<p>through the Eloor Service Co-operative Bank Ltd., Udyogamandal<\/p>\n<p>branch. But the notice of demand was issued by a counsel at<\/p>\n<p>Kollam. Alleging that the cause of action has arisen at Kollam, the<\/p>\n<p>complaint was filed before the Court at Kollam and cognizance<\/p>\n<p>was taken. Petitioner contends that no part of the cause of action<\/p>\n<p>has arisen at Kollam.         To justify the initiation of proceedings<\/p>\n<p>before the Court at Kollam, it was asserted that the notice of<\/p>\n<p>demand has been issued by the counsel at Kollam. There is no<\/p>\n<p>circumstances whatsoever that can justify the initiation of<\/p>\n<p>proceedings before the Kollam Court, it is submitted.                 The<\/p>\n<p>Tr.P.(Crl). No. 58 OF 2008<br \/>\n<span class=\"hidden_text\">                                   -:2:-<\/span><\/p>\n<p>petitioner stoutly contends that the complainant does not has his<\/p>\n<p>place of residence at Kollam and that the cheque was not handed<\/p>\n<p>over at Kollam.\n<\/p>\n<p>      2. At this stage it would be hazardous for this Court to<\/p>\n<p>resolve the controversy on facts as to whether the complainant<\/p>\n<p>resides at Kollam or whether the cheque was handed over at<\/p>\n<p>Kollam or not.        It is by now trite that mere fact that notice of<\/p>\n<p>demand was issued through a counsel at Kollam, shall not confer<\/p>\n<p>the jurisdiction on the courts at Kollam to entertain a complaint<\/p>\n<p>under Section 138 of the Negotiable Instruments Act.<\/p>\n<p>      3.     I have considered whether the transfer sought would<\/p>\n<p>advance the cause of justice. The complainant, it does appear<\/p>\n<p>has roots at Ernakulam, he having presented the cheque for<\/p>\n<p>encashment at his account with a bank at Udyogamandal branch.<\/p>\n<p>I am in these circumstances satisfied that the transfer can be<\/p>\n<p>directed as prayed for.        Such a direction, I am satisfied shall<\/p>\n<p>advance the interests of justice.        The learned counsel for the<\/p>\n<p>respondent in the course of arguments, accepts that transfer can<\/p>\n<p>Tr.P.(Crl). No. 58 OF 2008<br \/>\n<span class=\"hidden_text\">                                     -:3:-<\/span><\/p>\n<p>be directed as prayed for.\n<\/p>\n<p>      4. In the result:\n<\/p>\n<blockquote><p>            a) This Tr.P(Crl) is allowed.\n<\/p><\/blockquote>\n<blockquote><p>            b) CC No.1125\/07 pending before the JFMC-I, Kollam is<\/p>\n<p>            transferred to the court of JFMC, North Paravoor. JFMC-<\/p>\n<p>            I, Kollam shall forthwith transmit records to the JFMC,<\/p>\n<p>            North Paravoor.      The parties are directed to appear<\/p>\n<p>            before the JFMC, North Paravoor on 24.11.08 without<\/p>\n<p>            waiting for any further notice\/process from the court.<\/p>\n<\/blockquote>\n<p>      5.
