Ramaswamy<br \/>\n\t      Hon&#8217;ble Mr.Justice G.D.Pattanaik<br \/>\nP.K.Goswami, Sr.Adv., Rajiv Mehta, C.K.Sasi and Kailash<br \/>\nVasdev, Advs. with him for the appellant<br \/>\nS.N.Chaudhri, Sr. Adv. and S.A.Syed, Adv. with him for the<br \/>\nRespondents.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\nThe following Order of the Court was delivered:<br \/>\nAssam Madhyamik Sikshak Aru<br \/>\nKarmachari Santha, Nagaon.\n<\/p>\n<p>V.\n<\/p>\n<p>The State of Assam &amp; Ors.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\n     We have heard learned counsel on both sides.<br \/>\n     Leave granted.\n<\/p>\n<p>     This appeal  by special  leave arises  from  the  order<br \/>\ndated September\t 27, 1994 made in W.A. No. 90\/94. As regards<br \/>\nthe  validity\tof  Section  4(3)  of  the  Assam  Secondary<br \/>\nEducation (Provincialisation) Act, 1977 (Assam Act No.XIX of<br \/>\n1977) (for  short, the\t&#8216;Act&#8217;)\twhich  deals  with  teachers<br \/>\nworking\t in   the  aided  institutions\ttaken  over  by\t the<br \/>\nGovernment  under   the\t State\tAct  with  effect  from\t the<br \/>\nappointed  day\twho  were  recognized  to  be  the  existing<br \/>\nemployees with\treference to  the appointed day. Sub-section<br \/>\n(3) of\tSection 4 envisages that notwithstanding anything in<br \/>\nthe preceding  Section, all  employees other  than Grade  IV<br \/>\nemployees of a Secondary School coming within the purview of<br \/>\nthe Act, shall retire on superannuation of 58 years. Grade V<br \/>\nemployees on  attaining the  age  of  60  years,  shall\t get<br \/>\nsuperannuated. But  such of  those teachers  who  intend  to<br \/>\ncontinue  on  service  beyond  58  years,  are\trequired  to<br \/>\nexercise their option either to the Pension Scheme or to the<br \/>\npayment of  C.P.F. Scheme.  Such of  the teachers who opt to<br \/>\nretire on  attaining the  age of 58 years, shall be entitled<br \/>\nto the payment of pension and those who opt to continue till<br \/>\nthe completion\tof 60  years, are entitled to the C.P.F. The<br \/>\ndiscrimination is  discriminable based\ton policy.  No fault<br \/>\ncan be\tfound in this behalf. Teachers of the Provincialised<br \/>\nSecondary Schools  who had  not exercised  their option\t for<br \/>\neither o&#8217;  the scheme,\twere deemed  to have  not  exercised<br \/>\ntheir option  for the  latter scheme  and  are\trequired  to<br \/>\nretire on attaining the age of 58 years.\n<\/p>\n<p>     It is the case of the appellant-Association of teachers<br \/>\nthat since  Rules have\tnot been  made, no  option has\tbeen<br \/>\ngiven to  the teachers\tand they  remained in  service\ttill<br \/>\ncompletion of  60 years.  In the  case of  teachers who\t had<br \/>\nremained in  service after the appointed day and were yet to<br \/>\ncomplete the  age of  60 years,\t the State Government itself<br \/>\nhas resolved  to treat\tthem as Government teachers entitled<br \/>\nto pension  on attaining  the age of 58 years but the salary<br \/>\npaid to such teachers would not be recovered from them.\n<\/p>\n<p>     In view of the above resolution, it is contended by Mr.<br \/>\nP.K. Goswami,  learned\tsenior\tcounsel\t appearing  for\t the<br \/>\nAssociation, that  the same  benefit may  be  given  to\t the<br \/>\nteachers who continued as teachers on appointed day, namely,<br \/>\nOctober 1,  19?7 and  those who\t remained  in  service\ttill<br \/>\nattaining  60  years  be  treated  as  Government  employees<br \/>\nentitled  to  the  benefit  of\tthe  pension.  The  admitted<br \/>\nposition is  that they\thad already  withdrawn their  C.P.F.<br \/>\nwhich was  due to  them after  their attaining the age of 60<br \/>\nyears. Such  of the  teachers who  had withdrawn  the C.P.F.<br \/>\nshould redeposit  the same  to the credit of the government.<br \/>\nOn such\t deposit being\tmade, the State is directed to Treat<br \/>\nthem at\t par with the second category of teachers as per the<br \/>\ndraft Rules  now made  and to  treat them as if they are the<br \/>\nGovernment teacher  on the  appointed day and on that basis,<br \/>\nthey would  be entitled to pensionary benefits as applicable<br \/>\nto  all\t  the  Government  employees  who  would  retire  on<br \/>\nattaining the  age of 58 years and other benefits admissible<br \/>\nto them.\n<\/p>\n<p>     The appeal is accordingly disposed of.
