  Jade Hobli, max; Taluk. The plainti\ufb01”, defendant and one<\/p>\n

Gadigeppa Gowda are the sons of one A’ <\/p>\n
On 22.9.1955 there was a pax\ufb01tion in  _<\/p>\n
‘Shjvabasappagowda, i.e., the  _ <\/p>\n
defendant, wherein all the p\u00bbm_pe11:i’ esA     ‘V
\nShjvabasappagowda was
\nThe said parti\ufb01on deed is E1;c.P1 in
\nthe original suit. Though  place, the
\nplainti\ufb02, defendexr\ufb01  to BIVC along
\nwith their   at axe time when the
\npartition    to live together
\neven  their  for a long time. In the
\nsaid partitieisethe  land was allotted to the<\/p>\n

V.   in favour of one Siddappa under a<\/p>\n
 It is recited in the said sale deed that<\/p>\n
 an  veij?  day possession of the suit schedule<\/p>\n

  was gven certain lands to his exclusive share which<\/p>\n

\nclaims that   date of \ufb01\ufb01ng of the
\nsuit, he    enjoyment of the suit
\nschedule   “denies that one year prior to
\nthe dag. gr  oi’ the  the parties started living<\/p>\n

REASONS<\/p>\n
 A perusal cf the Judgment and Decree passed by the<\/p>\n
    appellate C0111! clearly discloses that it has gone in to the<\/p>\n

case. Admittedly, the relationship b\u00a2t\u20ac\u00a2\u00a2ea mg  <\/p>\n
defendant is not in dispute. The   <\/p>\n
partition in the family in the  is.V7aIs9′ n\u00a7t%;i1id”a:i$p\u00a7i\u00a2.
\nWhat is being disputed  ghc   dtieczdvgby the
\ndefendant on 28.07.1961   pursuant to
\nthe partition and    suit schedule
\npmperty in     acts by the
\nplainti\ufb01   Pmperty. The stand
\ntaken byigicfenddzit me we deed executed by him<\/p>\n
in \ufb02avour of “Si_\u00a7id.apj3a   is that he was a minor<\/p>\n
_ as ozzgyjziiat. date} ifhe  of defendant is taken in to<\/p>\n
  ..%,1s\u00ab.9n the date of execution of Ex.P1, wherein it<\/p>\n
  aged 13 years, the age of the defendant<\/p>\n
2  as  would be about 19 years. Admittedly, the<\/p>\n
”  Ex.P1 is prepared by the \ufb01ther of plaintiff and<\/p>\n
A  who was a school-teacher and was await: of the<\/p>\n

 \ufb01jitcntzioned by him in Ex.P1, cannot be disputed. It is also<\/p>\n

He is a graduate. In the year 1961, when he <\/p>\n
sale deed i.c., on 28.07.1961. in favour of S\ufb01dapp$””\ufb01e..’_j%:\u00a7e  _<\/p>\n
matured enough to understand what his age K  ”  <\/p>\n
Ex.Ij).16, Transfer Certi\ufb01cate, may   <\/p>\n
defendant is little less than 18  a\u00e9mti’-that  3:-i” A<\/p>\n
appellate Court has rightly not g’\u00a7\u00e9n,T:much  to the

W   he executed a sale deed in favour of Siddappa<\/p>\n
A  1961, the said sale deed is only a nominal salc \u00e9ecd<\/p>\n
   was not intended to convey the suit scheduic pmperty<\/p>\n
    favour of Siddappa and no right, title or possession of the<\/p>\n
suit schedule pmpcrty is conveyed to him. With this kind of<\/p>\n

of some stray document to say that he was a <\/p>\n

year 1951 itself is rightly rejected by 1-\u00e9fappelkuc e ”  <\/p>\n
