Advocate\n\nHon'ble Sheo Kumar Singh,J.\n<\/pre>\n<p>Hon&#8217;ble Shyam Shankar Tiwari,J.\n<\/p>\n<p>Heard Sri Tufail Hasan, learned Advocate who appeared to<br \/>\npress bail application moved on behalf of Shethi @ Shri<br \/>\nDayal who is appellant in Criminal Appeal No. 7943 of 2009<br \/>\nand learned Additional Government Advocate for the State.\n<\/p>\n<p>Learned Government side has filed objection to the appeal<br \/>\nand thus although the record is not available today but in<br \/>\nview of the submissions as advanced\/noted the matter has<br \/>\nbeen heard.\n<\/p>\n<p>Applicant above named was prosecuted for the offence<br \/>\npunishable under Sections so mentioned in the judgment<br \/>\nand he is to serve out the sentence so provided.\n<\/p>\n<p>Submission is that it is a case where the deceased has<br \/>\nreceived knife injuries and the role of giving knife blow is to<br \/>\nAmitabh Bachchan . Submission is that the only charge<br \/>\nagainst the applicant is that he was having knife which<br \/>\nAmitabh took from him and thus he committed the offence.\n<\/p>\n<p>Submission is that on the facts so proved there is absolutely<br \/>\nno motive to commit the offence and it is just for the reasons<br \/>\nso given in the prosecution version and otherwise, applicant<br \/>\nhas been named.\n<\/p>\n<p>Submission is that the appellant was on bail during trial and<br \/>\nhe did not misuse the same and as the appeal is not so old it<br \/>\nwill take some time in its disposal, the appellant is entitled to<br \/>\nbe released on bail.\n<\/p>\n<p>Learned Additional Government Advocate to oppose the<br \/>\naforesaid submits that although submission that appellant<br \/>\nhas not caused any injury to the deceased and the role of<br \/>\ncausing injury to the deceased is given to Amitabh but as<br \/>\nappellant was having knife which was used, and therefore,<br \/>\n after conviction he is not entitled to be released on bail.\n<\/p>\n<p>After hearing the aforesaid and on notice of the details it is<br \/>\nclear that appellant is just said to be having knife with him<br \/>\nwhich was taken by Amitabh, the co-accused for causing<br \/>\ninjury to the deceased. Appellant is said to have caused no<br \/>\ninjury to the deceased and thus at this stage a clear<br \/>\ndistinction can be drawn between the case of Amitabh and<br \/>\nthat of the appellant.\n<\/p>\n<p>Appellant was on bail during trial and he claims to have not<br \/>\nmisused the same and the appeal is not so old and thus it<br \/>\nwill take long time in its disposal, thus the appellant is<br \/>\nentitled to be enlarged on bail.\n<\/p>\n<p>On the facts, and totality of the circumstances this court is of<br \/>\nthe considered view that the appellant is entitled to be<br \/>\nenlarged on bail.\n<\/p>\n<p>Accordingly, let the appellant Shethi @ Shri Dayal involved<br \/>\nin S.T.No. 392 of 2008, be enlarged on bail on his furnishing<br \/>\na personal bond and two sureties each in the like amount to<br \/>\nthe satisfaction of the Court concerned.\n<\/p>\n<p>Realization of fine in respect to above appellant to the extent<br \/>\nof fifty percent shall remain stayed. Balance amount of fine<br \/>\nshall be deposited forthwith.
