Justice M.SASIDHARAN NAMBIAR\n\n Dated :17\/12\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n\n            ---------------------------------------------\n            CRL.M.C.NO.4463 OF 2010\n            ---------------------------------------------\n            Dated 17th December, 2010\n\n\n                           O R D E R\n<\/pre>\n<p>          Petitioners are accused 1 and 2 in<\/p>\n<p>S.C.101\/2004    on        the         file          of    Additional<\/p>\n<p>Sessions Judge (Adhoc-III), Kasargod, taken<\/p>\n<p>cognizance for the offences under Sections<\/p>\n<p>376,  116,312,      448        and        506(ii)         read  with<\/p>\n<p>Section 34 of Indian Penal Code. Prosecution<\/p>\n<p>case is that four months earlier to 22\/7\/1999,<\/p>\n<p>first petitioner went to house No.MP.IV\/649 of<\/p>\n<p>Kollam Harijan Colony where second respondent<\/p>\n<p>was residing and committed rape on her. On<\/p>\n<p>22\/7\/1999  first        petitioner               along     with  his<\/p>\n<p>brothers, the second petitioner and deceased<\/p>\n<p>third accused, criminally trespassed into her<\/p>\n<p>house and abetted second respondent to undergo<\/p>\n<p>abortion in a hospital and when she declined,<\/p>\n<p>Crmc 4463\/10<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>she was threatened that she will be killed and<\/p>\n<p>the    accused   thereby  committed  the  offences.<\/p>\n<p>Petition is filed under Section 482 of Code of<\/p>\n<p>Criminal      Procedure   contending  that   entire<\/p>\n<p>disputes      with  the   second  respondent   were<\/p>\n<p>settled amicably and first petitioner       married<\/p>\n<p>the second respondent and three children were<\/p>\n<p>born          in   that   wedlock   and  in    such<\/p>\n<p>circumstances, it is not in the interest of<\/p>\n<p>justice to continue the prosecution.<\/p>\n<p>            2. Second respondent appeared through a<\/p>\n<p>counsel and filed an affidavit stating that<\/p>\n<p>subsequent to the registration of the case,<\/p>\n<p>disputes      with   the   accused   were   settled<\/p>\n<p>amicably, due to intervention of mediators, and<\/p>\n<p>first petitioner married       her    and they are<\/p>\n<p>residing together and three children were born<\/p>\n<p>in    that    wedlock  and  she  has  no  grievance<\/p>\n<p>Crmc 4463\/10<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>against the petitioners and six witnesses have<\/p>\n<p>already      been  examined   and  the   case  was<\/p>\n<p>adjourned indefinitely for the examination of<\/p>\n<p>her father and in view of the settlement, she<\/p>\n<p>has no objection for quashing the proceedings.<\/p>\n<p>            3.   Learned   Public   Prosecutor  on<\/p>\n<p>instructions     submitted  that  first petitioner<\/p>\n<p>married second respondent and they are living<\/p>\n<p>together as husband and wife and subsequent to<\/p>\n<p>the incident two children were born,       who are<\/p>\n<p>now    aged 7 and 5 years.\n<\/p>\n<p>            4.  Learned  counsel appearing for the<\/p>\n<p>petitioners,     second  respondent  and   learned<\/p>\n<p>Public Prosecutor     were heard.\n<\/p>\n<p>            5.   Prosecution case  is  that  first<\/p>\n<p>petitioner      committed  rape   on   the  second<\/p>\n<p>respondent, four months earlier to 22\/7\/1999<\/p>\n<p>and when she was pregnant, on 22\/7\/1999 first<\/p>\n<p>Crmc 4463\/10<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<p>petitioner along with his brothers, the second<\/p>\n<p>petitioner and third accused trespassed into<\/p>\n<p>the house and induced her to undergo abortion<\/p>\n<p>and when she refused they threatened her. The<\/p>\n<p>very fact that second respondent did not raise<\/p>\n<p>any objection for four months, in spite of the<\/p>\n<p>fact that she became pregnant indicates that<\/p>\n<p>sexual      intercourse  was  with  her  consent.<\/p>\n<p>Subsequent conduct strengthen that fact. More<\/p>\n<p>over,      first petitioner later  married second<\/p>\n<p>respondent      and   two   children  were   born<\/p>\n<p>thereafter. In such circumstances, it is not in<\/p>\n<p>the     interest   of  justice  to  continue  the<\/p>\n<p>prosecution,     on   the  peculiar  facts    and<\/p>\n<p>circumstances of the case. If so, it is not in<\/p>\n<p>the     interest   of  justice  to  continue  the<\/p>\n<p>prosecution. Though this cannot be treated    as<\/p>\n<p>a    precedent,    on   the  peculiar  facts  and<\/p>\n<p>Crmc 4463\/10<br \/>\n<span class=\"hidden_text\">                           5<\/span><\/p>\n<p>circumstances of the case, in the interest of<\/p>\n<p>justice      the prosecution is to be quashed.<\/p>\n<p>            Petition is allowed.
