JUSTICE J.A.K.SAMPATHKUMAR           \n\n\nHabeas Corpus Petition No.137 of 2006 \n\nKala Duraipandian                              Petitioner\n\n-Vs-\n\n1.  The Secretary\n   to the Government\n   of Tamil Nadu,\n   Prohibition and\n   Excise Department.,\n   Fort St. George,\n   Madras 600 009.\n\n2. The District Magistrate and\n   District Collector,\n   Pudukottai District,\n   Pudukottai.                                  Respondents\n\nPRAYER :  Writ Petition under Article 226 of the Constitution of India seeking\nto issue a Writ of Habeas Corpus calling  for  the  records  relating  to  the\ndetention order  in  Ref.   No.P.D.O.No.15\/2005 dated 4.1 2.2005 passed by the\nsecond respondent and quash the same and further directing the respondents  to\nproduce  the  body  of  the  person  of  the detenu namely Duraipandian son of\nSivaperumal before this Honourable  Court,  who  is  now  detained  under  Act\n14\/1982  and  confined  at  the  Central Prison, Tiruchirapalli and set him at\nliberty.\n\n!For Petitioner :  Mr.AR.L.Sundaresan\n\n^For Respondents :  Mr.M.K.Subramanian,  \n                Government Advocate (Crl.  Side)\n\n:ORDER  \n<\/pre>\n<p>        (Order of the court was made by P.SATHASIVAM, J.)<\/p>\n<p>        Petitioner is  the  wife  of the detenu.  She challenges the detention<br \/>\norder Ref.    No.P.D.O.No.15\/2005  dated  4.12.2005  passed  by   the   second<br \/>\nrespondent.\n<\/p>\n<p>        2.  Heard both sides.  At the foremost, the learned  counsel  for  the<br \/>\npetitioner  submitted  that  there  is delay in disposal of the representation<br \/>\nwhich vitiates the detention order.\n<\/p>\n<p>        3.  The particulars furnished by the learned Government Advocate  show<br \/>\nthat  the  representation  was  received  by  the  Government  on 14.12.2005 .<br \/>\nRemarks were called for on 19.12.2005.  Remarks  were  received  on  2.1.2006.<br \/>\nThe  Under Secretary and the Deputy Secretary dealt with the file on 3.1.2006.<br \/>\nFinally, the Minister for Prohibition and Excise passed order on 4.1.2006  and<br \/>\nrejection  letter  was  prepared  on 5.1.2006 and it was sent to the detenu on<br \/>\n6.1.2006 which was served on 11.1.2006.\n<\/p>\n<p>        4.  As rightly pointed out by the learned counsel for the  petitioner,<br \/>\nthough  the  office  of  the Collectorate received the representation from the<br \/>\nGovernment 21.12.2005, remarks were called from the  Sponsoring  authority  on<br \/>\n23.12.2005  and  remarks  were  received  from the Sponsoring Authority by the<br \/>\nCollectorate on 26.12.2006, having received the materials\/information,  it  is<br \/>\nnot  clear  as to why the office of the Collectorate kept those materials till<br \/>\n31.12.2005.  Only on the fifth day, the office of the  Collectorate  sent  the<br \/>\nreport to  the  Government  for  necessary  action.   In the absence of proper<br \/>\nexplanation by the  person  concerned  for  taking  time  from  26.12.2005  to<br \/>\n31.12.2005,  we  hold  that the delay is on the higher side which, ultimately,<br \/>\nvitiates the order of detention.  On  this  ground,  the  detention  order  is<br \/>\nquashed.\n<\/p>\n<p>        5.   Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and the<br \/>\nimpugned order of detention is quashed.  The detenu is directed to be  set  at<br \/>\nliberty forthwith from the custody unless he is required in some other case or<br \/>\ncause.\n<\/p>\n<p>ssk.\n<\/p>\n<p>To\n<\/p>\n<p>1.
