\n\tway of present application, filed under Section 439 of the Code of
\n\tCriminal Procedure, 1973, the applicants have prayed to release them
\n\ton regular bail in connection with CR No.I-209 of 2011 registered
\n\twith Kagdapith Police Station 365 read with Section 114 of the
\n\tIndian Penal Code.\n<\/p>\n
Heard
\n\tMr.A.D. Shah with Mr.Ekant Ahuja, learned counsel for the applicants
\n\tand Ms.C.M. Shah, learned Additional Public Prosecutor for
\n\trespondent-State.\n<\/p>\n
Mr.Shah,
\n\tlearned counsel for the applicants, has contended that the
\n\tvictim-Thakorbhai Soni has to pay Rs.5.78 lacs to present
\n\tapplicants-accused towards gold and silver ornaments purchased
\n\tthrough applicant No.2. Normally the victim used to pay 50% of the
\n\ttotal amount at the time of taking delivery and the remaining amount
\n\twas being paid by him within 2 to 3 days to applicant No.2. As the
\n\toutstanding amount was to the tune of Rs.5.78 lacs, applicant No.2
\n\tcontacted the victim on his mobile for recovery of the amount.
\n\tTherefore, the victim sent three cheques of Rs.98,000\/- each drawn
\n\ton Central Bank of India to applicant No.2, but, at the same time,
\n\tthe victim also informed applicant No.2 to wait for some time as the
\n\tnecessary funds arrangement could not be made. Relying on the
\n\tvictim, applicant No.2 did not deposit the said cheques on 10th
\n\tAugust, 2011 and thereafter on 25th August, 2011.
\n\tHowever, as the amount is big, applicant No.2  persuade the victim
\n\tfor making the payment. It is also contended by Mr.Shah, learned
\n\tcounsel for the applicants, that after some time the victim even
\n\tstopped responding. Thereafter, upon inquiring, the victim was found
\n\tat S.T. Bus Stop of Ahmedabad and when the applicants asked the
\n\tvictim as to why he was not paying the amount, the victim was not
\n\tproperly answered and, therefore, the applicants took the victim to
\n\this father. Mr.Shah, learned counsel for the applicants, has further
\n\tcontended that the applicants were not used force or any coercion.
\n\tThe victim himself gone with the applicants to his father’s house.
\n\tHe was not kidnapped as per the say of the complainant. Mr.Shah
\n\tfurther contended that the victim has criminal antecedents. On the
\n\tcontrary, the applicants are victimized by the victim. This is a
\n\tcase of civil dispute. He has further contended that investigation
\n\tis also biased. The Investigating Officer has not properly carried
\n\tout the investigation. He has further contended that present
\n\tcomplaint is bogus and fabricated one. Just to avoid the payment,
\n\tpresent complaint is filed. The applicants are falsely implicated in
\n\tthe alleged office. He, therefore, contended that looking to the
\n\toverall facts and circumstances of the case, applicants may kindly
\n\tbe released on bail.\n<\/p>\n
Ms.C.M.\n<\/p>\n
\tShah, learned Additional Public Prosecutor, has vehemently opposed
\n\tthe present application. She has read the police papers and
\n\tcontended that the applicants are involved in a serious case and
\n\ttherefore, present application may not be entertained.\n<\/p>\n
In
\n\tthe facts and circumstances of the case and considering the nature
\n\tof allegations and role attributed to the applicants and without
\n\tentering into the merits of the case, prima facie, this Court is of
\n\tthe opinion that this is a fit case to exercise the discretion to
\n\tenlarge the applicants on bail.\n<\/p>\n
Hence,
\n\tthe applicants are ordered to be released on bail in connection with
\n\tCR No.I-209 of 2011 registered with Kagdapith Police Station, for
\n\tthe offence alleged against them in this application on their
\n\texecuting a bond of Rs.10,000\/- (Rupees ten thousand only) each with
\n\tone solvent surety of the like amount to the satisfaction of the
\n\ttrial Court and subject to the conditions that they shall –\n<\/p>\n
a)\tnot
\ntake undue advantage of their liberty or\tabuse their liberty;\n<\/p>\n
b)\tnot
\nto try to tamper or pressurise the prosecution \twitnesses or
\ncomplainant in any manner;\n<\/p>\n
c)\tmaintain
\nlaw and order and should cooperate the \tInvestigating Officer;\n<\/p>\n
d)\tnot
\nact in a manner injurious to the interest of\tthe prosecution;\n<\/p>\n
e)\tnot
\nleave the State of Gujarat without prior\tpermission of the Sessions
\nJudge concerned;\n<\/p>\n
f)\tmark
\ntheir presence before the Investigating\tOfficer on every 15th
\nday of each English calendar\tmonth between 09.00 hours and 14.00
\nhours;\n<\/p>\n
g)\tfurnish
\nthe address of their residence to the\tInvestigating Officer\tand also
\nto the Court at the \ttime of execution of \tthe bond and shall
\nnot\tchange the residence without prior permission of\tthis Court;\n<\/p>\n
h)\tsurrender
\ntheir passport, if any, to the lower \tCourt within a week.\n<\/p>\n
If
\n\tthe breach of any of the above conditions is committed, the
\n\tconcerned Court will be free to issue warrant or take appropriate
\n\taction in the matter.\n<\/p>\n
Bail
\n\tbefore the lower Court having jurisdiction to try the case. It would
\n\tbe open to the trial Court concerned to give time to furnish the
\n\tsolvency certificate if prayed for. Rule is made absolute.\n<\/p>\n
Direct
\n\t\t\tservice is permitted.\n<\/p>\n
