BASANT, J.\n\n               -------------------------------------------------\n\n                       CRL.M.C.NO. 4047 OF  2006\n\n               -------------------------------------------------\n\n           Dated this the 19th day of December, 2006\n\n\n                                     ORDER\n<\/pre>\n<p>       The   petitioner   is   the   5th          accused   and   faces   the<\/p>\n<p>allegations, inter alia,   under  Sec.376 of the IPC.          He was<\/p>\n<p>enlarged   on   bail   as   per   order   dated   19\/10\/2006   in<\/p>\n<p>B.A.No.5976\/06   subject   to   conditions.     The   conditions   oblige<\/p>\n<p>him   to   make   himself   available   for   interrogation   before   the<\/p>\n<p>Investigating Officer on all Wednesdays between 10 a.m. and<\/p>\n<p>11 a.m. till 25\/10\/2006 and thereafter, on the first working day<\/p>\n<p>of every month till  the trial  is complete.   The investigation is<\/p>\n<p>not completed.   The further conditions are  that the petitioner<\/p>\n<p>should   not   leave   the   State   of   Kerala   till   the   trial   is   over   and<\/p>\n<p>that he must surrender his passport which shall be retained by<\/p>\n<p>the Investigating Officer  until the trial is over.<\/p>\n<p>       2.     The   learned   counsel   for   the   petitioner   submits   that<\/p>\n<p>the investigation is not complete yet and the petitioner, who is<\/p>\n<p>employed   abroad   and   has   to   make   visits   to   his   place   of<\/p>\n<p>employment abroad, would be deprived of his livelihood if he<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO. 4047 OF  2006  -: 2 :-<\/span><\/p>\n<p>were to remain in  India till the trial is over.  The learned counsel<\/p>\n<p>for   the   petitioner,   in   these   circumstances,   prays   that   the<\/p>\n<p>conditions  imposed   may   be   modified.       It  is  further  undertaken<\/p>\n<p>that the petitioner shall make himself available for interrogation<\/p>\n<p>before   the  Investigating   Officer    or   the   court   as   and   when<\/p>\n<p>directed by the court.     Appropriate conditions may be imposed<\/p>\n<p>to ensure his presence for the purpose of investigation\/trial.<\/p>\n<p>      3.     Having   considered   all   the   relevant   inputs,   I   am<\/p>\n<p>persuaded to agree that the conditions imposed can be modified<\/p>\n<p>subject to appropriate safeguards.\n<\/p>\n<\/p>\n<p>      4.  This petition is, in these circumstances, allowed in part.<\/p>\n<p>Following further directions are issued:<\/p>\n<p>      (i)     The   petitioner   shall   comply   with   condition   No.(b)   till<\/p>\n<p>25\/1\/07.   Thereafter, the petitioner shall make himself available<\/p>\n<p>before   the  Investigating   Officer  or   the   court   concerned   on<\/p>\n<p>condition   that   notice   requiring   his   presence   before   the<\/p>\n<p>Investigating   Officer\/court  is  served  on  one   of  the   sureties to<\/p>\n<p>be specified by the petitioner.\n<\/p>\n<\/p>\n<p>      (ii)   The passport issued to the petitioner shall be released<\/p>\n<p>to   him   on   condition   that   he   shall   produce   the   same   before   the<\/p>\n<p><span class=\"hidden_text\"> CRL.M.C.NO. 4047 OF  2006  -: 3 :-<\/span><\/p>\n<p>court as and when directed.\n<\/p>\n<\/p>\n<p>        (iii)     The   petitioner   shall   execute   a   bond   for   Rs.1,00,000<\/p>\n<p>(Rupees   one   laksh   only)   with   two   solvent   sureties   each   for   the<\/p>\n<p>like   sum   undertaking   to   comply   with   the   above   further<\/p>\n<p>directions.\n<\/p>\n<\/p>\n<p>                                                      Sd\/-\n<\/p>\n<p>                                                   (R.
