No.4283 of 2008\n                      -------------------------------------\n            Dated this the 24th day of November, 2008\n\n                                  ORDER\n<\/pre>\n<p>      Petitioners are accused 1 and 2 and they face indictment in<\/p>\n<p>a prosecution for offences punishable, inter alia, under Section<\/p>\n<p>294 (b) and 506(ii) read with 34 I.P.C. All other offences are<\/p>\n<p>legally compoundable. Investigation is complete. Final report<\/p>\n<p>has already been filed. Altogether there are three victims in the<\/p>\n<p>crime. They are respondents 1 to 3. Cognizance has been taken<\/p>\n<p>on the basis of a final report filed by the police after due<\/p>\n<p>investigation.\n<\/p>\n<p>      2.    The petitioners along with respondents 1 to 3 have<\/p>\n<p>now come before this Court to apprise this Court of the fact that<\/p>\n<p>the parties have settled their disputes and respondents 1 to 3<\/p>\n<p>have compounded the offences allegedly committed by the<\/p>\n<p>petitioners.   Though some of the offences alleged are not<\/p>\n<p>compoundable under Section 320 Cr.P.C,                      the parties have<\/p>\n<p>willingly   and   voluntarily        settled        their   disputes.   The<\/p>\n<p>extraordinary inherent jurisdiction under Section 482 Cr.P.C<\/p>\n<p>may be invoked to bring to premature termination the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.4283 of 2008         2<\/span><\/p>\n<p>prosecution against the petitioners. It is prayed that the dictum<\/p>\n<p>in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> [2008 (3) KLT<\/p>\n<p>19], <a href=\"\/doc\/393489\/\">Nikhil Merchant v. C.B.I<\/a> [2008(3) KLT 769 (SC)] and<\/p>\n<p>Manoj Sharma v. State [2008 (4) KLT 417 (SC)] may be<\/p>\n<p>invoked to terminate the unnecessary and irrelevant continuance<\/p>\n<p>of the prosecution against the petitioners.<\/p>\n<p>     3.    Notice was given to the learned Public Prosecutor.<\/p>\n<p>The learned Public Prosecutor after taking instructions submits<\/p>\n<p>that the State is convinced that the matter has been settled. The<\/p>\n<p>dispute is one which is private and personal between the parties.<\/p>\n<p>The State has no objection against quashing of proceedings<\/p>\n<p>against the petitioners and accepting composition.<\/p>\n<p>     4.    I   have    considered    all  the   relevant   inputs.<\/p>\n<p>Respondents 1to 3 have entered appearance through counsel.<\/p>\n<p>They have filed affidavit to confirm such settlement\/composition.<\/p>\n<p>I am satisfied that the dispute is private and personal between<\/p>\n<p>the parties. I take note of the stand taken by the State. I take<\/p>\n<p>note of the nature of the alleged offence. Having considered all<\/p>\n<p>the relevant circumstances, I am satisfied that this is an<\/p>\n<p>eminently fit case where the extraordinary inherent jurisdiction<\/p>\n<p>under Section 482 Cr.P.C as enabled by the dictum in Madan<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.4283 of 2008         3<\/span><\/p>\n<p><a href=\"\/doc\/1442974\/\">Mohan Abbot v. State of Punjab, Nikhil Merchant<\/a> v. C.B.I<\/p>\n<p>and Manoj Sharma v. State (supra) can safely be invoked to<\/p>\n<p>bring to premature termination the prosecution against the<\/p>\n<p>petitioners.\n<\/p>\n<p>      5.   In the result:\n<\/p>\n<p>      i)   This Crl.M.C is allowed;\n<\/p>\n<p>      ii)  C.C.No.1207 of 2006 pending before the Judicial<\/p>\n<p>Magistrate of the First Class-II, Thrissur wherein the petitioners<\/p>\n<p>are   the   accused    and    respondents   1  to   3   are   the<\/p>\n<p>victims\/complainants, is hereby quashed;<\/p>\n<p>      iii) Needless to say, proceedings, if any, under Section<\/p>\n<p>446 Cr.P.C pending against the petitioners and their sureties<\/p>\n<p>shall be disposed of in accordance with law.<\/p>\n<p>                                           (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Shri.Vibeesh vs Smt.Radha on 24 November, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Crl.MC.No. 4283 of 2008() 1.
