Sema &amp; Lokeshwar Singh Panta\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<\/p>\n<p>O R D E R<br \/>\nCIVIL APPEAL NOS.4247-4248 OF 2001<\/p>\n<p>\tHeard Mr. T.S. Doabia, learned senior counsel for the<br \/>\nUnion of India, and Ms. Kamini Jaiswal, learned counsel<br \/>\nappearing for the Union Territory of Chandigarh.  None<br \/>\nappears on behalf of the principal respondents-Dr. Jai Dev<br \/>\nWig and Dr. M.S. Sekhon.\n<\/p>\n<p>\tThe challenge in these appeals is to the orders dated<br \/>\n7.8.1998 in CWP No. 12360-C\/1998 and 8.7.1999 in CWP<br \/>\n6169-C\/1998 passed by the High Court of Punjab and<br \/>\nHaryana at Chandigarh.\n<\/p>\n<p>\tDespite receipt of notice, principal respondents-Dr. Jai<br \/>\nDev Wig and Dr. M.S. Sekhon are not represented either by<br \/>\nthemselves or by a counsel.  It was contended that by this<br \/>\ntime they might have retired from service.<br \/>\n\tBriefly stated the facts are as follows:\n<\/p>\n<p>\tThe respondent-Dr. Jai Dev Wig was working as<br \/>\nAdditional Professor, Department of Surgery, Post Graduate<br \/>\nInstitute of Medical Education and Research, Chandigarh.<br \/>\nThe Government of India, Ministry of Home Affairs,<br \/>\nDepartment of Personnel &amp; A.R., issued an Office<br \/>\nMemorandum dated 9.4.1981 on the subject of relaxation of<br \/>\nupper age limit for departmental candidates in Government<br \/>\ndepartments giving relaxation of a maximum of 5 years in the<br \/>\nupper age limit for recruitment to other Group A or Group B<br \/>\nposts through an advertisement by the Commission.  The<br \/>\nrespondent-Dr. Jai Dev Wig filed an application before the<br \/>\nCentral Administrative Tribunal claiming benefit of age<br \/>\nrelaxation provided to the Government servants in terms of the<br \/>\naforesaid office memorandum.  The Tribunal allowed the<br \/>\napplication.\n<\/p>\n<p>\tAggrieved thereby, the Union Public Service Commission<br \/>\nfiled a writ petition before the High Court as aforesaid.  By the<br \/>\nsaid order the High Court was of the view that the post held by<br \/>\nthe principal respondent was akin to the Government servant<br \/>\nand, therefore, he is entitled to the relaxation.  The High Court<br \/>\nwas, however, of the view that the provisions of Article 311 of<br \/>\nthe Constitution of India do not apply to the employees of the<br \/>\nInstitute.  Before the High Court, it was the case of the<br \/>\nCommission that Dr. Wig was overage as on the cut-off-date<br \/>\nand he being not in Government service was not eligible for<br \/>\nthe benefit of relaxation.  The said contention was repelled by<br \/>\nthe High Court holding Dr. Jai Dev Wig entitled to the<br \/>\nrelaxation at par with the Government servants.<br \/>\n\tIt is not in dispute that the Post Graduate Institute in<br \/>\nwhich respondents-Dr. Jai Dev Wig and Dr. M.S. Sekhon were<br \/>\nserving is a creation by an Act of Parliament and as such it is<br \/>\nan autonomous body.  However, the services of the<br \/>\nrespondents were not covered by the proviso to Article 309 of<br \/>\nthe Constitution.  Article 311, as held by the High Court, was<br \/>\nalso not attracted in their case.  Therefore, in our considered<br \/>\nopinion it cannot be held that the respondents are<br \/>\nGovernment servants.  The benefit of Office Memorandum<br \/>\ndated 9th April, 1981 giving relaxation of upper age limit for<br \/>\ndepartmental candidates for appointment to Group A and<br \/>\nGroup B posts cannot be legally extended to the service<br \/>\nconditions of Dr. Jai Dev Wig and Dr. M.S. Sekhon.<br \/>\n\tThus, the contrary view taken by the High Court holding<br \/>\nboth the respondents entitled for benefit of relaxation in terms<br \/>\nof the aforesaid Office Memorandum is erroneous and cannot<br \/>\nbe sustained.  The appeals are allowed in the aforesaid terms.<br \/>\nThe orders of the High Court as well as the order of the<br \/>\nTribunal granting benefit to the respondents shall stand set<br \/>\naside.  We may clarify that in the meantime if any benefit of<br \/>\nthe order of relaxation has been given to Dr. Jai Dev Wig and<br \/>\nDr. M.S. Sekhon by the concerned authority, such benefit<br \/>\nshall not be withdrawn from them.
