Justice V.RAMKUMAR\n\n Dated :17\/09\/2010\n\n O R D E R\n                           V.RAMKUMAR, J.\n                ----------------------------------------------\n                Bail Application No.5567 of 2010\n               ------------------------------------------------\n           Dated this the 17th day of September, 2010\n\n                                  ORDER\n<\/pre>\n<p>        The petitioners, who are accused Nos.1 to 4 in Crime<\/p>\n<p>No.312\/2009 of Bekal Police Station for offences punishable under<\/p>\n<p>Sections 323, 324 &amp; 308 read with Section 34 I.P.C., seek<\/p>\n<p>anticipatory bail.\n<\/p>\n<p>      2.    The learned Public Prosecutor opposed the application.<\/p>\n<p>      3.     Anticipatory bail cannot be granted in a case of this<\/p>\n<p>nature.    But at the same time, I am inclined to permit the<\/p>\n<p>petitioners to surrender before the Investigating Officer for the<\/p>\n<p>purpose of interrogation and then to have their application for bail<\/p>\n<p>considered by the Magistrate having jurisdiction. Accordingly, the<\/p>\n<p>petitioners shall surrender before the investigating officer on<\/p>\n<p>27\/9\/2010 or on 28\/9\/2010 for the purpose of interrogation and<\/p>\n<p>recovery of incriminating material, if any.
