  (Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n
\tThe
\npresent application is filed by the convict through Jail seeking
\ntemporary bail for a period of 21 days  so as to perform post death
\nrituals on account of sad demise of the mother of the convict, who
\ndied on 6th October 2010.\n<\/p>\n
2.\t Rule.\n<\/p>\n
 Mr.K.P. Raval,  learned Additional Public Prosecutor waives service
\nof rule on  behalf of the respondent-State.  The learned APP invited
\nattention of the Court to the Jail remarks.\n<\/p>\n
3.\tThe
\napplicant- appellant- original has by now undergone  4 years, 5
\nmonths and 2 days in Jail as on 10.03.2011.  He has enjoyed temporary
\nbail once from 23.12.2010 to 05.01.2011.  He is not able to enjoy any
\nfurlough because the Police has given negative opinion and the surety
\nsuggested by the convict was not ready to be surety.\n<\/p>\n
This Court is
\nnoticing that the Inspector General, Prison passed mechanical orders
\nwithout being mindful of the fact that even if the convict having
\nundergone for a period like  4 years in the present
\ncase, the Police is giving negative opinion and on the ground that
\nsurety is not ready to stand surety, the convict is deprived of his
\nfurlough.  The matter is required to be considered seriously by the
\nInspector General, Prison, more particularly when the convict is
\nreleased by the order of this Court, that too waiving the execution
\nof surety.  In the present case the Court granted temporary bail to
\nthe present convict by order dated 26th October 2010  in
\nCriminal Misc. Application No.12421 of 2010, the relevant part of the
\norder reads as under:\n<\/p>\n
“The
\nground, even if sympathetically considered, the convict will have to
\nfurnish surety.  In view of the above, considering the facts and
\ncircumstances, the applicant-convict  is ordered to be released on
\ntemporary bail  for a period of two weeks from the date of his actual
\nrelease on condition that he furnishes  surety of Rs. 1,000\/-  and
\nexecutes a personal bond  in the sum of Rs. 5,000\/-, and with
\nadditional condition that upon expiry of the bail period, he shall
\nsurrender to the jail authority.  This application is allowed to the
\naforesaid extent.  Rule is made absolute accordingly.”\n<\/p>\n
4.\tLater on, it
\nwas brought to the notice of the Court that the convict is not able
\nto arrange for surety and an application was filed praying that the
\ncondition of providing surety be deleted.  The Court in Criminal
\nMisc. Application No.13636 of 2010 passed the following order on
\n08.12.2010:\n<\/p>\n
“2.\tThe
\npresent application has been preferred by the applicant –
\nconvict through the jail authorities for deletion of the condition of
\nsurety of Rs.1,000\/- since, as per him, there is nobody to stand as
\nsurety.\n<\/p>\n
3.\tIt
\nappears from the earlier order passed by this Court read with the
\njail report that he is being released for the first time and the
\nfurlough has also become due.  It is on account of his financial
\ncondition, nobody is ready to stand as surety.\n<\/p>\n
4.\t Hence,
\nconsidering the facts and circumstances, the earlier order dated
\n26.10.2010 shall stand modified to the effect that the condition of
\nfurnishing surety of Rs.1,000\/- shall stand deleted.”
\n (emphasis supplied)<\/p>\n
5.\tThe
\nInspector General, Prison is expected to take the underlying message
\nin these two orders  and pass appropriate orders in accordance with
\nlaw.\n<\/p>\n
6.\tIn view of
\nthe above and for the contents of the application, the application is
\nallowed.  The applicant- convict is ordered to be released on
\n temporary bail for 21 (twenty one)  days from the date
\nof his release  on his executing a personal bond of Rs.5000\/- (Rupees
\nfive thousand only) to the satisfaction of the Jail authorities.\n<\/p>\n
7.\tThe
\napplicant shall surrender himself to the Jail authorities on expiry
\nof the above temporary bail period.\tRule is made absolute.\n<\/p>\n
