In the normal course, when the petitioner seeks<br \/>\n\tpermission to withdraw the petition, the Court would have no<br \/>\n\thesitation in granting such permission. But this is a different<br \/>\n\tcase.\n<\/p>\n<p>\tThe Management<br \/>\n\tof the respondent College is in the habit of extracting the amount<br \/>\n\tfrom the students and for genuine reasons, if the admissions are not<br \/>\n\treceived by the students, the amount has not been paid back.  There<br \/>\n\tare so many cases of this nature.  Hence, this petition should be<br \/>\n\ttreated as a representative petition and objections are to be<br \/>\n\tinvited from all those affected students whose amounts have not been<br \/>\n\tpaid by the Management to those students.  Before passing an order<br \/>\n\tof advertisement inviting objections, one more opportunity is given<br \/>\n\tto the College authorities.  It is very unfortunate that despite<br \/>\n\tspecific order passed by this Court directing the Principal of the<br \/>\n\trespondent College to remain personally present, no one appears and<br \/>\n\teven after service of the notice, though the respondent College has<br \/>\n\tdirectly settled the issue with the petitioner, did not choose to<br \/>\n\tremain present before the Court.\n<\/p>\n<p>In<br \/>\n\tview of the above observation, the Registry is directed to issue<br \/>\n\tSummons to the Principal of the respondent College securing his<br \/>\n\tpresence before the Court<br \/>\n\ton 16.06.2010.
