{"id":159538,"date":"2011-10-21T00:00:00","date_gmt":"2011-10-20T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/tilsunra-devi-vs-laxmina-devi-ors-on-21-october-2011"},"modified":"2018-10-17T14:31:27","modified_gmt":"2018-10-17T09:01:27","slug":"tilsunra-devi-vs-laxmina-devi-ors-on-21-october-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/tilsunra-devi-vs-laxmina-devi-ors-on-21-october-2011","title":{"rendered":"Tilsunra Devi vs Laxmina Devi &amp; Ors on 21 October, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Tilsunra Devi vs Laxmina Devi &amp; Ors on 21 October, 2011<\/div>\n<pre>                   IN THE HIGH COURT OF JUDICATURE AT PATNA\n                                CWJC No.10020 of 2011\n                                      Tilsunra Devi\n                                           Versus\n                                   Laxmina Devi &amp; Ors\n                                        -----------\n<\/pre>\n<p>06.   21.10.2011                Heard the learned counsel, Mr. Abhimanyu<\/p>\n<p>                    Sharma on behalf of the petitioner and the learned<\/p>\n<p>                    counsel, Mr. Binit Kumar on behalf of the respondents.<\/p>\n<p>                                (2)   This application under Article 227 of the<\/p>\n<p>                    Constitution of India has been filed by the petitioner for<\/p>\n<p>                    setting aside the order dated 18.04.2011 passed in title<\/p>\n<p>                    suit no.181 of 2005 and Matrimonial Case No.37 of 2010<\/p>\n<p>                    by Principal Judge, Family Court, Buxar whereby the<\/p>\n<p>                    learned Court below held that he has the jurisdiction to<\/p>\n<p>                    entertain the suits and thereby rejected the application<\/p>\n<p>                    dated 06.10.2010 under Section 9 of the C.P.C. and also<\/p>\n<p>                    held that the matrimonial suit is not barred under Section<\/p>\n<p>                    11 C.P.C. and rejected the application dated 23.01.2010.<\/p>\n<p>                                (3) The short facts may be stated herein that<\/p>\n<p>                    the plaintiff-respondent no.1 filed the title suit no.181 of<\/p>\n<p>                    2005 for declaration that she is legally wedded wife of late<\/p>\n<p>                    Kashinath Prasad and that respondent nos.2 and 3 are the<\/p>\n<p>                    sons born out of the wed lock. In the said suit, it was also<\/p>\n<p>                    prayed for declaration that the gift deed dated 29.12.2000<\/p>\n<p>                    executed in favour of the petitioner by said late Kashinath<\/p>\n<p>                    Prasad is illegal, void and inoperative and not binding on<\/p>\n<p>                    the plaintiff.    The said suit was pending before the<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>Subordinate Judge.        On establishment of Family Court in<\/p>\n<p>the District of Buxar, the Subordinate Judge by terms of<\/p>\n<p>order dated 05.08.2009 transferred the case to the Family<\/p>\n<p>Court for decision.\n<\/p>\n<p>             (4) The present petitioner appeared and filed<\/p>\n<p>an application under Section 9 of the C.P.C. alleging that<\/p>\n<p>the Family Court has no jurisdiction to decide the case as<\/p>\n<p>the relief claimed in the suit is for declaration of the gift<\/p>\n<p>deed executed by Kashinath in favour of the petitioner.<\/p>\n<p>Another application was also filed by the petitioner to the<\/p>\n<p>effect that in 125 Cr.P.C. proceeding being case no.38(M)<\/p>\n<p>of 2002, the S.D.J.M., Buxar has held that the plaintiff is<\/p>\n<p>not wedded wife of late Kashinath Prasad. Therefore, the<\/p>\n<p>finding will operate as res-judicata and accordingly, prayed<\/p>\n<p>for disposal of the suit under Section 11 of the C.P.C. By<\/p>\n<p>the impugned order, both the applications have been<\/p>\n<p>rejected.\n<\/p>\n<p>             (5) The learned counsel for the petitioner<\/p>\n<p>submitted that since prayer has been made for declaration<\/p>\n<p>of the gift deed as null and void, the Family Court has no<\/p>\n<p>jurisdiction and likewise, because there has already been<\/p>\n<p>finding in 125 Cr.P.C. proceeding that the plaintiff is not<\/p>\n<p>legally married wife, the same will operate as res-judicata.<\/p>\n<p>In such view of the matter, the learned Court below could<\/p>\n<p>not have rejected the application. Therefore, the impugned<\/p>\n<p>order is liable to be set aside.\n<\/p>\n<p><span class=\"hidden_text\">                      3<\/span><\/p>\n<p>             (6) On the contrary, according to the learned<\/p>\n<p>counsel for the respondents, there is no illegality in the<\/p>\n<p>impugned order. Under Section 7 of the Family Court Act,<\/p>\n<p>1984, the Family Court is also a Civil Court and has the<\/p>\n<p>jurisdiction to decide the matrimonial suit and according to<\/p>\n<p>Order 2, the plaintiff is required to include the whole claim<\/p>\n<p>and if plaintiff will omit to include the whole claim, the<\/p>\n<p>plaintiff will not be entitled subsequently to sue for the<\/p>\n<p>same. According to the learned counsel, the plaintiff filed<\/p>\n<p>the suit for declaration that she is the legally wedded wife<\/p>\n<p>of late Kashinath Prasad. So far Family Court is concerned,<\/p>\n<p>the same has the jurisdiction to grant this relief and so far<\/p>\n<p>the subsequent relief i.e. for declaration that the gift deed<\/p>\n<p>is void is concerned, it is consequential, it depends upon<\/p>\n<p>the former relief.       Considering all aspects of the matter,<\/p>\n<p>the learned Court below has passed the impugned order<\/p>\n<p>and, therefore, there is no illegality in it.<\/p>\n<pre>             (7)     Section 7 of the Family Court Act,\n\n1984 reads as follows:\n\n<\/pre>\n<p>7.Jurisdiction-(1) Subject to the other provisions of this<\/p>\n<p>Act, a Family Court shall-\n<\/p>\n<p>(a) have and exercise all the jurisdiction exercisable by any<\/p>\n<p>district court or any subordinate civil court under any law<\/p>\n<p>for the time being in force in respect of suits and<\/p>\n<p>proceeding of the nature referred to in the explanation;<\/p>\n<p>and<br \/>\n<span class=\"hidden_text\">                    4<\/span><\/p>\n<p>(b) be deemed, for the purposes of exercising such<\/p>\n<p>jurisdiction under such law, to be a district court or, as the<\/p>\n<p>case may be, such subordinate civil court for the area to<\/p>\n<p>which the jurisdiction of the Family court extends.<\/p>\n<p>Explanation- The suits and proceedings referred to in this<\/p>\n<p>sub-section are suits and proceedings of the following<\/p>\n<p>nature, namely:-\n<\/p>\n<p>(a) a suit or proceeding between the parties to a marriage<\/p>\n<p>for a decree of nullity of marriage (declaring the marriage<\/p>\n<p>to be null and void or, as the case may be, annulling the<\/p>\n<p>marriage) or restitution of conjugal rights or judicial<\/p>\n<p>separation or dissolution of marriage;\n<\/p>\n<p>(b) a suit or proceeding for a declaration as to the validity<\/p>\n<p>of a marriage or as to the matrimonial status of any<\/p>\n<p>person;\n<\/p>\n<p>(c) a suit or proceeding between the parties to a marriage<\/p>\n<p>with respect to the property of the parties or of either of<\/p>\n<p>them;\n<\/p>\n<p>(d) a suit or proceeding for an order or injunction in<\/p>\n<p>circumstances arising out of a marital relationship;<\/p>\n<p>(e) a suit or proceeding for declaration as to the legitimacy<\/p>\n<p>of any person;\n<\/p>\n<p>(f) a suit or proceeding for maintenance;\n<\/p>\n<p>(g) a suit or proceeding in relation to the guardianship of<\/p>\n<p>the person or the custody of, or access to, any minor.<\/p>\n<p>(2) Subject to the other provisions of this Act, a Family<br \/>\n<span class=\"hidden_text\">                    5<\/span><\/p>\n<p>Court shall also have and exercise-\n<\/p>\n<p>(a) the jurisdiction exercisable by a Magistrate of the First<\/p>\n<p>Class under Chapter IX(relating to order for maintenance<\/p>\n<p>of wife, children and parents) of the Code of Criminal<\/p>\n<p>Procedure, 1973(2 of 1974); and<\/p>\n<p>(b) such other jurisdiction as may be conferred on it by<\/p>\n<p>any other enactment.&#8221;\n<\/p>\n<p>             (8)   From the above provision of law it is<\/p>\n<p>evident that a Family Court has been conferred with all the<\/p>\n<p>jurisdiction exercisable by any District Court or any<\/p>\n<p>Subordinate Civil Courts in respect of the suits and<\/p>\n<p>proceedings of the nature specified in the explanation and<\/p>\n<p>for the purpose of exercising such jurisdiction, the Family<\/p>\n<p>Court is treated as District Court or Subordinate Civil<\/p>\n<p>Courts.\n<\/p>\n<p>            (9) In view of Section 7(i) explanation (b), the<\/p>\n<p>Family Court has the jurisdiction to decide a suit or<\/p>\n<p>proceeding for a declaration as to the validity of a marriage<\/p>\n<p>or as to the matrimonial status of any person.          In the<\/p>\n<p>present case, the suit has been filed for declaration that<\/p>\n<p>the plaintiff is the legally wedded wife of late Kashinath<\/p>\n<p>Prasad. Therefore, so far this declaration is concerned, the<\/p>\n<p>Family Court has the jurisdiction to decide the same.<\/p>\n<p>            (10) Order 2 Rule 2 of the C.P.C. provides that<\/p>\n<p>every suit shall include the whole of the claim which the<\/p>\n<p>plaintiff is entitled to make in respect of the cause of<br \/>\n<span class=\"hidden_text\">                       6<\/span><\/p>\n<p>action.   Order 2 Rule 2 Sub Rule 2 provides that if the<\/p>\n<p>plaintiff omits to sue      in respect of       or   intentionally<\/p>\n<p>relinquishes    any   portion   of   his   claim,   he   shall   not<\/p>\n<p>afterwards sue in respect of the portion so omitted or<\/p>\n<p>relinquished and Sub Rule 3 provides that a person entitled<\/p>\n<p>to more than one relief in respect of the same cause of<\/p>\n<p>action may sue for all or any such relief.\n<\/p>\n<p>               (11) In the present case, as stated above, the<\/p>\n<p>preliminary relief claimed by the plaintiff is for declaration<\/p>\n<p>of her status. The second relief is for declaration regarding<\/p>\n<p>gift deed executed by late Kashinath Prasad.             Therefore,<\/p>\n<p>this second relief has been claimed by the plaintiff in view<\/p>\n<p>of Order 2 Rule 2 C.P.C. Had the plaintiff not claimed this<\/p>\n<p>relief in the suit, the said relief could not have been<\/p>\n<p>claimed by her subsequently being barred under Order 2<\/p>\n<p>Rule 2 C.P.C. As has been quoted above, the Family Court<\/p>\n<p>is treated as District Court or the Subordinate Courts for<\/p>\n<p>deciding the Civil Suits. Now, therefore, the question will<\/p>\n<p>be whether this second relief regarding gift deed is<\/p>\n<p>concerned, if it is held that Family Court has no jurisdiction<\/p>\n<p>to decide this question then in such circumstances, the<\/p>\n<p>plaintiff will be compelled to file another suit before either<\/p>\n<p>the Court of Munsif or the Court of Sub Judge as the case<\/p>\n<p>may be, according to the valuation. In my opinion, this is<\/p>\n<p>not the intention of legislature i.e. the plaintiff will file a<\/p>\n<p>suit before one Court for one relief and another suit before<br \/>\n<span class=\"hidden_text\">                        7<\/span><\/p>\n<p>another Court for another relief. Since the Family Court is<\/p>\n<p>a Civil Court and according to Section 7, has the<\/p>\n<p>jurisdiction    to    decide    all    suits    and    proceedings          as<\/p>\n<p>enumerated in the explanations, the same Court has the<\/p>\n<p>jurisdiction to decide the consequential relief claimed in the<\/p>\n<p>suit also. Here, if the former relief regarding declaration of<\/p>\n<p>status will be dismissed, she will not be entitled to the<\/p>\n<p>grant of second relief.\n<\/p>\n<p>               (12) Now let us consider that if it is held that<\/p>\n<p>Family Court has no jurisdiction to declare the gift deed as<\/p>\n<p>void or illegal, then the consequence will be that the<\/p>\n<p>plaintiff will be compelled to file suit. The question will be<\/p>\n<p>as to whether in the said suit, the Court will grant this<\/p>\n<p>relief without deciding the status of the plaintiff as to<\/p>\n<p>whether &#8220;she is legally wedded wife or not?&#8221;                   So far this<\/p>\n<p>question regarding her status is concerned, the other Court<\/p>\n<p>will have no jurisdiction and will have await the decision of<\/p>\n<p>the Family Court and, therefore, the decision of the Family<\/p>\n<p>Court   regarding      the     declaration      of    status    is    prime<\/p>\n<p>consideration. In my opinion, therefore, the Family Court<\/p>\n<p>has the jurisdiction to decide the suit and the learned Court<\/p>\n<p>below has rightly held so by the impugned order.<\/p>\n<p>               (13) So far the other ground that the finding<\/p>\n<p>that the marriage is void as the first husband of plaintiff is<\/p>\n<p>alive and that there is finding of S.D.J.M. in 125 Cr.P.C.<\/p>\n<p>proceeding     that    she     is     not   legally   wedded         wife   is<br \/>\n<span class=\"hidden_text\">                              8<\/span><\/p>\n<p>          concerned, it appears that the scope of Section 125 Cr.P.C.<\/p>\n<p>          is different than the scope of regular suit regarding<\/p>\n<p>          declaration of status.      Therefore, the finding recorded by<\/p>\n<p>          S.D.J.M. in 125 Cr.P.C. proceeding is a finding recorded by<\/p>\n<p>          a Criminal Court which will never operate as res-judicata in<\/p>\n<p>          the Civil proceeding before the Family Court. The learned<\/p>\n<p>          Court below has rightly therefore, held the same.<\/p>\n<p>                      (14)       In    view   of    the   above    facts   and<\/p>\n<p>          circumstances of the case, I find no reason to interfere<\/p>\n<p>          with the impugned           order   and   accordingly,    this   writ<\/p>\n<p>          application is dismissed.\n<\/p>\n<\/p>\n<pre>Saurabh                                       ( Mungeshwar Sahoo, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
