Radhakrishnan, J.\n        ==================================\n              W.P.(C)No.15169 of 2008\n        ==================================\n       Dated this the 11th day of June, 2008.\n\n\n                     JUDGMENT\n<\/pre>\n<p>    Petitioner,  a  State  Government  owned  farm,<\/p>\n<p>faces an order under the EPF and MP Act, 1952<\/p>\n<p>imposing damages.   It filed an appeal before the<\/p>\n<p>second respondent and an application for stay of<\/p>\n<p>all further proceedings pursuant to Ext.P1 order.<\/p>\n<p>But it did not get any order of stay.  It is stated<\/p>\n<p>that  it  happened   only  because   the  Appellate<\/p>\n<p>Tribunal was not sitting.    Whatever that be, the<\/p>\n<p>EPF authorities proceeded with distress action and<\/p>\n<p>moneys of the petitioner in the hands of third<\/p>\n<p>respondent bank have been attached and taken over.<\/p>\n<p>Petitioner  challenges  such  action  and  seeks  a<\/p>\n<p>direction for return of such money.<\/p>\n<p>    2.  Having heard the learned counsel for the<\/p>\n<p>petitioner and the learned standing counsel for the<\/p>\n<p> WPC15169\/2008<\/p>\n<p><span class=\"hidden_text\">                         -:2:-<\/span><\/p>\n<p>first respondent, I do not deem it appropriate to<\/p>\n<p>issue any direction to refund the recovered amount,<\/p>\n<p>as of now.
