The\nburden was on the employer to prove that the petitioner was not in\ngainful employment during the course of retrenchment.\n       The facts of the case are that the petitioner was engaged on\n16.5.1996.    He worked up to 2.8.1999 and thereafter he was\nretrenched.   The petitioner challenged the order of retrenchment\nbefore the High Court in W.P.1970\/99 in which ad interim writ was\nissued but ultimately on 29.7.1999 the writ petition was dismissed.\nThereafter petitioner filed an L.P.A. No.294\/99 by which the matter\nwas disposed of with a direction to the respondents to comply with<\/pre>\n<p>the statutory provisions. Then the petitioner approached to the State<br \/>\nGovernment for a reference and the matter was referred to the<br \/>\nLabour Court under Section 10 of the Industrial Disputes Act,1947.<br \/>\nThe labour Court considered this aspect by the impugned order and<br \/>\nfound that the petitioner was entitled for re-instatement but without<br \/>\nback wages. The matter was earlier adjudicated by this Court and<br \/>\nonly for limited purposes the matter was remanded back.
