Heard learned counsel for the petitioner<\/p>\n<p>                    and the State.\n<\/p>\n<p>                            2. Tractor of the petitioner was seized<\/p>\n<p>                    while carrying stone chips which is said to have<\/p>\n<p>                    been extracted from the protected forest area.<\/p>\n<p>                    Disputing such claim petitioner objected to the<\/p>\n<p>                    confiscation of the vehicle-in-question. His plea<\/p>\n<p>                    was negatived by the Divisional Forest Officer<\/p>\n<p>                    under orders dated 12.8.2002, Annexure-5 against<\/p>\n<p>                    which he filed appeal before the Collector, Sasaram<\/p>\n<p>                    who also rejected the same under orders dated<\/p>\n<p>                    09.07.2004, Annexure-6. Petitioner assailed the<\/p>\n<p>                    aforesaid two orders by filing revision before the<\/p>\n<p>                    Forest Commissioner asserting before him that the<\/p>\n<p>                    seizure of the tractor made by the Forester was<\/p>\n<p>                    contrary to the provisions contained in Section 52<\/p>\n<p>                    D of the Indian Forest Act, 1927 as thereunder<\/p>\n<p>                    officer not below the rank of Range Officer is<br \/>\n<span class=\"hidden_text\">                           -2-<\/span><\/p>\n<p>         authorized to seize the vehicle.\n<\/p>\n<p>                 3. Having heard counsel for the petitioner<\/p>\n<p>         and the State, I direct the Forest Commissioner to<\/p>\n<p>         consider Revision Case No. 1MC26\/2004 in the<\/p>\n<p>         light of the submissions noted above that the<\/p>\n<p>         Forester was not competent to seize the vehicle as<\/p>\n<p>         also the other submissions raised by the petitioner<\/p>\n<p>         in the revision application, as early as possible, in<\/p>\n<p>         any case within a period of two months from the<\/p>\n<p>         date of receipt\/production of a copy of this order<\/p>\n<p>         before the Forest Commissioner.\n<\/p>\n<p>                 4.
