JUSTICE BIRENDRA PRASAD VERMA\n                 ORAL ORDER<\/pre>\n<p>                 (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>2   11-11-2011                 The delay of 12 days occurred in filing the Letters<br \/>\n                 Patent Appeal is condoned. Interlocutory application stands<br \/>\n                 disposed of.\n<\/p>\n<p>                               With the consent of the learned Advocates, this Appeal<br \/>\n                 is heard and decided today.\n<\/p>\n<p>                               Feeling aggrieved by the order dated 1st July 2011<br \/>\n<span class=\"hidden_text\"> 2   Patna High Court LPA No.1651 of 2011 (2) dt.11-11-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                          2\/4<\/span><\/p>\n<p>             made by the learned Single Judge in above CJWC No. 2510 of<br \/>\n             2011, the writ petitioner has preferred this Appeal under Clause 10<br \/>\n             of the Letters Patent.\n<\/p>\n<p>                            The subject matter of dispute is the punishment of<br \/>\n             withholding of increment for six months, without cumulative<br \/>\n             effect made by the Commandant, Bihar Military Police, against the<br \/>\n             appellant, a Havildar in the Bihar Military Police.\n<\/p>\n<p>                            A departmental proceeding was held against the<br \/>\n             appellant, a Havildar in the Bihar Military Police, for the alleged<br \/>\n             acts of commission and omission amounting to misconduct. The<br \/>\n             enquiry officer under his report dated 9th December 2009 recorded<br \/>\n             that the imputation of charge made against the appellant was not<br \/>\n             proved. Pursuant to the said enquiry report the disciplinary<br \/>\n             authority by his order dated 21st December 2009 recorded a<br \/>\n             finding of guilt against the appellant and imposed impugned<br \/>\n             punishment of withholding of increment for six months. The said<br \/>\n             order was upheld on 30th June 2010 in the Departmental Appeal<br \/>\n             No. 13\/2009. Challenge to the said order in above CWJC No.2510<br \/>\n             of 2010 has failed before the learned single Judge. Therefore, the<br \/>\n             present Appeal.\n<\/p>\n<p>                            The learned single Judge has dismissed the Appeal on<br \/>\n             the ground that the punishment imposed upon the appellant was a<br \/>\n             minor punishment and was inadequate compared to the nature of<br \/>\n             guilt proved against the appellant.\n<\/p>\n<p>                            Learned Advocate Mr. Ram Hriday Prasad has<br \/>\n             appeared for the appellant. He has submitted that under the police<br \/>\n             manual the punishment of withholding of the increment is<br \/>\n             classified as major punishment. Besides, the learned single Judge<br \/>\n             has not considered the challenge to the impugned order on the<br \/>\n<span class=\"hidden_text\"> 3   Patna High Court LPA No.1651 of 2011 (2) dt.11-11-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                          3\/4<\/span><\/p>\n<p>             ground that the appellant had not been supplied copy of the<br \/>\n             enquiry report; nor did the disciplinary authority call upon the<br \/>\n             appellant to explain why he should not be held guilty.\n<\/p>\n<p>                            We have perused the enquiry report and the order of<br \/>\n             the disciplinary authority. It can not be gainsaid that the enquiry<br \/>\n             officer recorded finding of &#8216;not guilty&#8217; in favour of the appellant.<br \/>\n             If the disciplinary authority did not agree with the finding recorded<br \/>\n             by the enquiry officer, he was required to give a notice to the<br \/>\n             appellant to show cause why, for the reasons recorded therein, the<br \/>\n             appellant should not be held guilty. Admittedly the aforesaid<br \/>\n             procedure had not been followed in the instant case. Neither the<br \/>\n             appellant had been given copy of the enquiry report; nor was he<br \/>\n             given a tentative finding of guilt recorded by the disciplinary<br \/>\n             authority; nor the appellant was called upon to show cause why he<br \/>\n             should not be held guilty.\n<\/p>\n<p>                            In our opinion, the aforesaid procedural lapse shall be<br \/>\n             fatal to the impugned order of punishment. To us it appears that<br \/>\n             the learned single Judge has considered the nature of allegation<br \/>\n             made against the appellant but has failed to appreciate the<br \/>\n             aforesaid procedural lapse in the disciplinary proceeding.\n<\/p>\n<p>                            For the aforesaid reasons, we allow this Appeal. The<br \/>\n             impugned order dated 1st July 2011 made by the learned single<br \/>\n             Judge in above CWJ C No. 2510 of 2011 is set aside.\n<\/p>\n<p>                            CWJC No. 2510 of 2011 is allowed. The order dated<br \/>\n             21st December 2009 made by the disciplinary authority against the<br \/>\n             appellant is quashed and set aside. Consequently, the appellate<br \/>\n             order dated 30th June 2010 also stands quashed and set aside.\n<\/p>\n<p>                            The disciplinary authority will be at liberty to continue<br \/>\n             with the departmental proceeding against the appellant, if so<br \/>\n<span class=\"hidden_text\"> 4           Patna High Court LPA No.1651 of 2011 (2) dt.11-11-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                  4\/4<\/span><\/p>\n<p>                     advised. In that case the appellant will be furnished copy of the<br \/>\n                     enquiry report and will be given a notice to show cause why the<br \/>\n                     appellant should not be held guilty for the reasons recorded in such<br \/>\n                     notice. In other words, the disciplinary proceeding will be held<br \/>\n                     afresh from the stage of the submission of the enquiry report by<br \/>\n                     the enquiry officer. The disciplinary authority will make the order<br \/>\n                     of punishment afresh, if required, without being guided or<br \/>\n                     influenced by anything said in this order or in the order of the<br \/>\n                     learned single Judge.\n<\/p>\n<p>                                    The parties will bear their own cost.\n<\/p>\n<p>                                                    (R.M.
