Justice R.BASANT\n\n Dated :05\/12\/2006\n\n O R D E R\n                                     R.BASANT, J\n\n                                  ----------------------\n\n                             W.P.C.No.34607 of 2005\n\n                            ----------------------------------------\n\n                  Dated this the 5th day of December   2006\n\n\n\n\n                                       O R D E R\n<\/pre>\n<p>       Against   the   petitioner,   an   interim   direction   for   payment   of<\/p>\n<p>maintenance   under   Section   125   Cr.P.C   has   been   passed   by   the<\/p>\n<p>learned Judge of the Family Court (copy of that order is produced as<\/p>\n<p>Ext.P4).  It reads as follows:\n<\/p>\n<blockquote><p>               &#8220;Heard   both   sides.     Considering   the   needs   of   the<\/p>\n<p>       petitioners   and   income   of   the   counter   petitioner   he   is<\/p>\n<p>       directed to pay Rs.700\/- to P1 and Rs.500\/- to P2 from the<\/p>\n<p>       date of this CMP.&#8221;<\/p><\/blockquote>\n<p>       2.      The   grievance   of   the   petitioner   raised   in   this  Criminal<\/p>\n<p>Miscellaneous   Case  is   that   inspite   of   the   fact   that   he   had   offered   to<\/p>\n<p>maintain   the   wife   on   condition   that   she   lives   with   him,   the   learned<\/p>\n<p>Judge of the Family Court had not at all adverted to that aspect.  The<\/p>\n<p>learned   counsel   for   the   petitioner   relies   on   Section   125(4)   Cr.P.C,<\/p>\n<p>which extract below:\n<\/p>\n<blockquote><p>       &#8220;125(4):  No wife shall be entitled to receive an [allowance<\/p>\n<p>       for   the   maintenance   or  the   interim   maintenance  and<\/p>\n<p>       expenses   of   proceeding,   as   the   case   may   be,]   from   her<\/p>\n<p>       husband under this section if she is living in adultery, or if,<\/p>\n<p>       without any sufficient reason, she refuses to live with her<\/p>\n<p>       husband,   or   if   they   are   living   separately   by   mutual<\/p>\n<p>       consent.&#8221;                                             (emphasis supplied<\/p>\n<\/blockquote>\n<blockquote><p>       3.      Whether   it   be   a   claim   for   maintenance   or   interim<\/p>\n<p>maintenance,   the   Family   Court   is   bound   to   consider   whether   the<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.34607\/05                            2<\/span><\/p>\n<p>refusal of the wife to live with the husband is justified or not.  A prima<\/p>\n<p>facie consideration on the basis of materials  available must certainly<\/p>\n<p>be undertaken even when the direction is to pay interim maintenance.<\/p>\n<\/blockquote>\n<p>The   impugned   order   extracted   above   does   not   at   all   show   that   the<\/p>\n<p>learned   Judge   of   the   Family   Court   had   pointedly   considered   this<\/p>\n<p>aspect of the matter.\n<\/p>\n<p>       4.      It   follows   therefore   that   the   direction   for   payment   of<\/p>\n<p>interim   maintenance   in   so   far   as   it   relates   to   the   first   claimant\/wife<\/p>\n<p>cannot be supported.   The same warrants interference.  So far as the<\/p>\n<p>child is concerned, there can be no dispute and the child is entitled for<\/p>\n<p>interim maintenance.\n<\/p>\n<p>       5.      In the result, this Criminal Miscellaneous Case    is allowed<\/p>\n<p>in part.  The direction for payment of interim maintenance for the first<\/p>\n<p>claimant\/wife  is set aside.
