{"id":159663,"date":"2010-07-09T00:00:00","date_gmt":"2010-07-08T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/radhey-raman-misra-and-others-vs-state-of-u-p-through-principal-on-9-july-2010"},"modified":"2018-07-17T03:18:20","modified_gmt":"2018-07-16T21:48:20","slug":"radhey-raman-misra-and-others-vs-state-of-u-p-through-principal-on-9-july-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/radhey-raman-misra-and-others-vs-state-of-u-p-through-principal-on-9-july-2010","title":{"rendered":"Radhey Raman Misra And Others vs State Of U.P.Through Principal &#8230; on 9 July, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Radhey Raman Misra And Others vs State Of U.P.Through Principal &#8230; on 9 July, 2010<\/div>\n<pre>                                                                        1\n\n                                                         Court No. 24\n\n              Writ Petition No. 3436 (MS) of 2010\nRadhey Raman Mishra &amp; others                             ...Petitioners\n\n                                Versus\n\nState of UP &amp; others                                    ...Respondents\n\n                                 AND\n\n                  Writ Petition No. 3514 (MS) of 2010\nMatapher Mishra                                          ...Petitioners\n\n                                Versus\n\nState of UP &amp; others                                    ...Respondents\n\n\n                              ------------\nHon'ble Rajiv Sharma, J.\n<\/pre>\n<p>      Heard Counsel for the parties.\n<\/p>\n<p>      By means of writ petition no. 3436 MS of 2010 the petitioners<br \/>\nhave assailed the order dated 15\/5\/2010, whereby the list of valid<br \/>\nmembers of the general body of the society Madhusoodan Vidyalaya<br \/>\nAssociation has been finalised and has been forwarded to the Sub<br \/>\nDivisional Magistrate, Sadar, Sultanpur for holding the elections of<br \/>\nthe committee of management of the society.\n<\/p>\n<p>      Matapher Mishra, who is said to be a member of the society,<br \/>\nhas filed the writ petition no. 3514 (MS) of 2010 and the prayer in<br \/>\nthis writ petition is same as claimed in the aforesaid writ petition no.<br \/>\n3436(MS) of 2010.\n<\/p>\n<p>      It has been argued that the membership of 40 members<br \/>\ninducted by the then President during the period of 2000-2003 has<br \/>\nbeen held to be invalid and 50 members whose induction was being<br \/>\nclaimed by the respondent no.5-Shailendra Shukla have been held<br \/>\nto be valid members. As per the bye-laws a member can only be<br \/>\ninducted after following due procedure as prescribed in clause-4 of<br \/>\nthe Bye-laws of the society. The Deputy Registrar has decided the<br \/>\nissue of membership solely on the basis of conjecture and surmises<br \/>\nand has neither considered the material placed before it nor the<br \/>\nrelevant provisions of the bye-laws and as such the Deputy Registrar<br \/>\n<span class=\"hidden_text\">                                                                     2<\/span><\/p>\n<p>has exercised jurisdiction vested in it with material irregularity. It<br \/>\nhas also been submitted that the Deputy Registrar accepted the<br \/>\nmembership of 50 members submitted by the respondent no.5 in<br \/>\nconsideration of the fact that some amount of money was deposited<br \/>\nin a bank account alleged to be of the society by misreading Section<br \/>\n15 of the Societies Registration Act, 1860 which provides that<br \/>\nmembers have to be first inducted in terms of the bye-laws and<br \/>\npayment of subscription is to be considered later.\n<\/p>\n<p>      On behalf of respondent no. 5 it has been submitted that once<br \/>\nthe society has been declared time barred for want of election of the<br \/>\noffice-bearers and the order stood final then finalization of list of<br \/>\nGeneral Body members after inviting objection of respective parties<br \/>\nvide order dated 15.5.2010 and declaring elections be held in<br \/>\nexercise of power under Section 25(2) of the Act, it is not amenable<br \/>\nunder writ jurisdiction.\n<\/p>\n<p>      Learned Standing Counsel states that initially there were 227<br \/>\nmembers and after 1996, fifty members were inducted. Learned<br \/>\nState Counsel as well as Sri S.C. Shukla states that the impugned<br \/>\norder has been passed by the Deputy Registrar after considering the<br \/>\nobjections raised by the members including the President. However,<br \/>\nboth the Counsel failed to satisfy the court that while passing the<br \/>\nimpugned order the Deputy Registrar has strictly followed the<br \/>\nprovisions of clause-4 of the bye-laws which relates to the procedure<br \/>\nprescribed for induction of members.\n<\/p>\n<p>      It is an admitted fact that as per clause-4 of the bye laws a<br \/>\nmember can only be inducted by the President. The two ingredients<br \/>\nas provided in the aforesaid clause are that there should be an order<br \/>\nin writing on an application and secondly the deposit of requite<br \/>\nmembership in the societies account. A perusal of the impugned<br \/>\norder shows that the Deputy Registrar has given much weightage to<br \/>\nthe receipt of membership fee but has overlooked the first ingredient<br \/>\nand as such it suffers from legal infirmities. It may be mentioned<br \/>\nthat the bye-laws of the society have been approved by the Deputy<br \/>\nRegistrar and as long as the same are in existence it has to be<br \/>\nfollowed in the manner as provided in the Bye-Laws. The Deputy<br \/>\nRegistrar cannot travel contrary to the bye-laws.\n<\/p>\n<p><span class=\"hidden_text\">                                                                      3<\/span><\/p>\n<p>       In the instant case, as averred above, the Deputy Registrar<br \/>\nhas erred in not considering the first ingredient of Clause-4 of the<br \/>\nbye-laws of the society and as such the impugned order cannot be<br \/>\nsustained. In my opinion,the Deputy Registrar has also overlooked<br \/>\nthe statutory provision as enumerated in Section 15 of the Societies<br \/>\nRegistration Act while passing the impugned order.\n<\/p>\n<p>       In view of the above, the impugned order dated 15.5.2010<br \/>\npassed by the Deputy Registrar is hereby set-aside. The Deputy<br \/>\nRegistrar is directed to decide the issue afresh after giving<br \/>\nopportunity of hearing to all concerned persons. All the parties are<br \/>\ndirected to co-operate with the Deputy Registrar and whatever<br \/>\ndocuments are required by him for deciding the issue shall be<br \/>\nfurnished by the society. The Deputy Registrar shall make earnest<br \/>\nendeavour to decide the issue latest by 31st August, 2010. It is<br \/>\nfurther provided that the election which has been fixed for 11th July,<br \/>\n2010 by the Election Officer shall be kept in abeyance and will again<br \/>\nbe notified after finalisation of list of members.\n<\/p>\n<p>       Both the writ petitions stand allowed in above terms.<br \/>\n9.7.2010<br \/>\nHM\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Radhey Raman Misra And Others vs State Of U.P.Through Principal &#8230;
