Case against petitioner is<\/p>\n<p>that   he committed offence under Section                     188 of<\/p>\n<p>Indian Penal Code and 17(4) read with section 22 of<\/p>\n<p>Kerala Protection of River Banks Regulation of Sand<\/p>\n<p>Mining   Act, 2001. Judicial First Class Magistrate,<\/p>\n<p>North Paravur   took cognizance of the offence on a<\/p>\n<p>complaint filed by Sub Inspector of Police, Eloor on<\/p>\n<p>18\/11\/2002.  This petition is filed to quash the FIR<\/p>\n<p>as well as Annexure-II final report for the reason<\/p>\n<p>that  on  18\/11\/2002,       when       the      offence   was   taken<\/p>\n<p>cognizance the Sub Inspector has no authority to file<\/p>\n<p>a complaint under Section 25 and only as                 per gazette<\/p>\n<p>notification    G.O(Ms)        No.11\/07\/RD           dated  10\/1\/2007<\/p>\n<p>published in  Kerala Gazette dated 18\/1\/2007,                 Station<\/p>\n<p>House officers  were given power                to file a complaint<\/p>\n<p>under Section 25 of        the Kerala Protection of River<\/p>\n<p>Banks Regulation of Sand Mining                   Act and therefore<\/p>\n<p>Annexure-I FIR and Annexure-II charge sheet are to                 be<\/p>\n<p>CRMC 1492\/09<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>quashed. Reliance was placed on the decision  in  <a href=\"\/doc\/376411\/\">Rijo<\/p>\n<p>v. State of Kerala and<\/a> another (2008 (1) KLT 664). It<\/p>\n<p>was also argued that offence under Section 188 cannot<\/p>\n<p>be taken cognizance unless  sanction was given by the<\/p>\n<p>court as provided under Section 195(1) and as no<\/p>\n<p>sanction was obtained, case for the offence under<\/p>\n<p>Section 188 of Indian Penal Code is also liable to be<\/p>\n<p>quashed. Learned counsel vehemently submitted that  as<\/p>\n<p>sanction is necessary  under Section 195(1) of Code of<\/p>\n<p>Criminal Procedure and no sanction was obtained from<\/p>\n<p>the court,   cognizance of the offence under Section<\/p>\n<p>188 of Indian Penal Code could not have been taken.<\/p>\n<p>Learned Public Prosecutor submitted that in view of<\/p>\n<p>the  decision   of  this   court  in     Rijo&#8217;s   case<\/p>\n<p>submission of the petitioner is tenable.<\/p>\n<p>          2.  In view of the decision of this court<\/p>\n<p>in Rijo&#8217;s case the petition can only be allowed. The<\/p>\n<p>cognizance of the offence was taken on 18\/11\/2002. But<\/p>\n<p>Sub Inspector  was authorised to file complaint under<\/p>\n<p>Section 25    by notification only w.e.f. 18\/1\/2007.<\/p>\n<p>Hence   learned   Magistrate   cannot   legally   take<\/p>\n<p>cognizance of the offence on 18\/11\/2002. It was bad.<\/p>\n<p>So   also   as no sanction was obtained under Section<\/p>\n<p>195(1) of Code of Criminal Procedure, cognizance of<\/p>\n<p>the offence   under Section 188 of Indian Penal Code<\/p>\n<p>CRMC 1492\/09<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>also could not have been taken by the Magistrate in<\/p>\n<p>2002. Hence the   petition is allowed.
