SINGH, JUDGE.    \nDate: 17\/04\/2009 \n:J U D G M E N T :\n<\/pre>\n<p>Services Selection Board, Srinagar\/Jammu<br \/>\nhad issued Advertisement Notice No. 01 of 1999<br \/>\ndated 09.03.1999 for Selection of candidates<br \/>\nagainst the Posts which included the posts of<br \/>\nDrivers in various Departments of the State<br \/>\nGovernment in their State\/Divisional\/District<br \/>\nCadres except District Leh, prescribing Middle<br \/>\nPass possessing Hill Road Driving Licence as<br \/>\nessential qualification for the posts.<br \/>\nAggrieved by the Selection of the private<br \/>\nrespondents as Drivers against Open and<br \/>\nReserved categories, Mehmood Akhtar Malik,<br \/>\n<span class=\"hidden_text\">2<\/span><br \/>\nMohd. Parvez and Harpal Singh, the three<br \/>\npetitioners, have filed this petition seeking<br \/>\nquashing of the Select List published by the<br \/>\nServices Selection Board in Daily Excelsior on<br \/>\n26.09.2001, besides seeking a command against<br \/>\nthe respondents to consider them for selection<br \/>\nand appointment against the posts.<br \/>\nThe State and its Services Selection Board<br \/>\nhave indicated in their response to the writ<br \/>\npetition that Mehmood Akhtar Malik, petitioner<br \/>\nNo.1 and Harpal Singh, petitioner No.3 had<br \/>\ncompeted for the District Cadre Posts whereas<br \/>\nMohd. Parvez, petitioner No.2 had competed for<br \/>\nthe Divisional Cadre Post of Drivers.<br \/>\nPetitioner Nos. 1 is stated to have obtained<br \/>\n55.99 points in the Open Category, whereas the<br \/>\nlast selected candidate in the Category in the<br \/>\nRajouri District had obtained 65.66 points.<br \/>\nPetitioner No.3 competing for District Cadre Posts<br \/>\nin Jammu had obtained 58.66 points, whereas<br \/>\nthe last selected candidate in the category had<br \/>\nobtained 67.99 points. As regards Mohd. Parvez,<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\npetitioner No.2, the respondents say that having<br \/>\napplied for seeking consideration against the<br \/>\nposts of Drivers falling in the Divisional Cadre, he<br \/>\ncould not question the selection of the<br \/>\nrespondents made against District Cadre posts.<br \/>\nDisputing the stand taken by the official<br \/>\nrespondents, petitioners learned counsel<br \/>\nsubmitted that petitioner No.2 had applied<br \/>\nseeking consideration against District Cadre Posts<br \/>\nand respondents had erred in refusing to consider<br \/>\nhis case for selection against the posts.<br \/>\nIn view of the merit position of the other<br \/>\npetitioners, the learned counsel was unable to<br \/>\nsupport rest of the petitioners case, in that being<br \/>\nless meritorious, they were not entitled to<br \/>\nselection for the advertised District Cadre posts.<br \/>\nDuring the course of consideration of the<br \/>\npetition, Mr. Shukla, learned counsel for the<br \/>\nBoard produced a photocopy of the Application<br \/>\nForm of petitioner No. 2 to indicate that the<br \/>\nsubmission made on behalf of the petitioner was<br \/>\nfactually incorrect as he had not sought<br \/>\n<span class=\"hidden_text\">4<\/span><br \/>\nconsideration for selection against District Cadre<br \/>\nPosts and had in fact applied for seeking<br \/>\nconsideration against State\/Divisional Cadre<br \/>\nPosts. This photocopy of the Application Form<br \/>\nproduced by Mr. Shukla is taken on records.<br \/>\nI have considered the submissions of learned<br \/>\ncounsel for the parties and perused the photocopy<br \/>\nof petitioner No.2s application seeking<br \/>\nappointment as Driver in Government Service.<br \/>\nPetitioner Nos. 1 &amp; 3s plea that they were<br \/>\nmeritorious and had been erroneously ignored<br \/>\nwhile issuing the list of candidates found selected<br \/>\nagainst the District Cadre Posts, is not supported<br \/>\nby any material on records.\n<\/p>\n<p>Statement made by the official respondents in<br \/>\ntheir response to the writ petition supported by<br \/>\nthe affidavit of the Administrative Officer of the<br \/>\nBoard has not been controverted by the<br \/>\npetitioners either by placing any material on<br \/>\nrecords indicating position contrary to the one<br \/>\naffirmed by the respondents or by filing any<br \/>\n<span class=\"hidden_text\">5<\/span><br \/>\naffidavit disputing the statement made by the<br \/>\nrespondents in their reply to the writ petition.<br \/>\nAccordingly, in the absence of any material<br \/>\non records indicating petitioner Nos.1 to 3 to be<br \/>\nsuperior in merit to the private respondents, the<br \/>\nSelection of the private respondents, who are<br \/>\nstated by the official respondents to have obtained<br \/>\nmore marks than the petitioners, cannot be<br \/>\nfaulted.\n<\/p>\n<p>Perusal of petitioner No.2s application form<br \/>\nindicates that against Column No. 4 of the<br \/>\napplication form requiring the candidates to<br \/>\nindicate the cadre for which they had applied,<br \/>\npetitioner No.2 had indicated his option for<br \/>\nseeking selection against State\/Divisional Cadre.<br \/>\nIt is thus apparent that petitioner No.2 had<br \/>\nnot applied seeking consideration for selection<br \/>\nagainst the District Cadre Posts of Drivers and in<br \/>\nsuch view of the matter, he does not possess any<br \/>\nright to question the selection of the respondents<br \/>\nwho had been selected against District Cadre<br \/>\nPosts.\n<\/p>\n<p><span class=\"hidden_text\">6<\/span><\/p>\n<p>For all what has been said above, there is no<br \/>\nmerit in the petitioners writ petition, which is,<br \/>\naccordingly, dismissed.\n<\/p>\n<p>(J.
