    Revision petitioners are accused 1 and 2 in<\/p>\n
C.C.621\/2003 on the file of Judicial First Class<\/p>\n
Magistrate-I, Aluva.    Second respondent is the<\/p>\n
complainant.     Second   respondent   lodged   the<\/p>\n
complaint against the first revision petitioner,<\/p>\n
the firm and the second revision petitioner its<\/p>\n
Managing Partner and    two other partners of the<\/p>\n
firm alleging that they committed the offence under<\/p>\n
section 138 of Negotiable Instruments Act.  Accused<\/p>\n
pleaded not guilty.    Learned Magistrate on the<\/p>\n
evidence of PW1 and Exts.P1 to P7 DW1 and Exts.D1<\/p>\n
and D2 found accused 3 and 4 not guilty and<\/p>\n
acquitted  them.      Revision   petitioners   were<\/p>\n
convicted for the offence under section 138 of<\/p>\n
Negotiable Instruments Act.  They were sentenced to<\/p>\n
simple imprisonment for one year, without taking<\/p>\n
note of the fact that first revision petitioner is<\/p>\n
CRRP4206\/2008              2<\/span><\/p>\n
only a firm.    Petitioners challenged the conviction<\/p>\n
and sentence before       Additional Sessions Court,<\/p>\n
North     Paravur   in   Crl.A.776\/2007.      Learned<\/p>\n
Additional    Sessions  Judge  on  reappreciation  of<\/p>\n
evidence confirmed the conviction.      But sentence<\/p>\n
was modified to a fine of Rs.1,25,000\/- as against<\/p>\n
the first revision petitioner firm and         simple<\/p>\n
imprisonment    for  three  months  and  a  fine   of<\/p>\n
Rs.10,000\/- and in default simple imprisonment for<\/p>\n
two months as against second revision petitioner<\/p>\n
with    a    direction  to   pay   Rs.1,25,000\/-   on<\/p>\n
realisation to second respondent as compensation.<\/p>\n
Revision is filed challenging the conviction and<\/p>\n
sentence.\n<\/p>\n
    2.     Learned counsel appearing for the revision<\/p>\n
petitioners was heard.\n<\/p>\n
    3. Learned counsel, in view of the evidence on<\/p>\n
record and the concurrent findings of fact did not<\/p>\n
challenge the conviction but sought modification of<\/p>\n
the sentence.     It was submitted that considering<\/p>\n
the fine awarded as against     firm the substantive<\/p>\n
CRRP4206\/2008              3<\/span><\/p>\n
sentence as against    second revision petitioner may<\/p>\n
be reduced as well as the fine.\n<\/p>\n
    4.       On going through the judgments of the<\/p>\n
courts below, I find no reason to interfere with<\/p>\n
the   conviction.      Evidence  establish  that   in<\/p>\n
discharge of the liability of first          revision<\/p>\n
petitioner firm, second revision petitioner being<\/p>\n
the Managing Partner issued the cheque which was<\/p>\n
dishonoured for want of sufficient funds and second<\/p>\n
respondent had complied with all the statutory<\/p>\n
formalities provided under section 138 and 142 of<\/p>\n
Negotiable Instruments Act.    Conviction of revision<\/p>\n
petitioners in such circumstance, for the offence<\/p>\n
under section 138 of Negotiable Instruments Act, is<\/p>\n
perfectly legal.\n<\/p>\n
    5.      Then the only question is regarding the<\/p>\n
sentence.       Learned  Additional  Sessions   Judge<\/p>\n
modified the sentence to a fine for the amount<\/p>\n
covered by the dishonoured cheque as against the<\/p>\n
firm and simple imprisonment for three months in<\/p>\n
addition to a fine of Rs.10,000\/- as against the<\/p>\n

Managing Partner the     second revision petitioner.<\/p>\n
Considering the entire facts and circumstances of<\/p>\n
the case, interest of justice will be met, if the<\/p>\n
sentence     is modified,  reducing  the  substantive<\/p>\n
sentence to imprisonment till rising of court.     So<\/p>\n
long as the sentence is not varied or modified<\/p>\n
against the interest of second respondent, it is<\/p>\n
not necessary to issue notice to second respondent.<\/p>\n
As per the modified sentence awarded by Sessions<\/p>\n
Judge second respondent is     to get a compensation<\/p>\n
of Rs.1,25,000\/- which was the amount covered by<\/p>\n
the dishonoured cheque.    In such circumstance, the<\/p>\n
sentence is modified as follows:-     First revision<\/p>\n
petitioner is sentenced to a fine of Rs.10,000\/-.<\/p>\n
Second    revision    petitioner   is   sentenced  to<\/p>\n
imprisonment till rising of court in addition to a<\/p>\n
fine   of    Rs.1,20,000\/-  and  in  default   simple<\/p>\n
imprisonment for one month.    On realisation of fine<\/p>\n
Rs.1,25,000\/- to be paid to second respondent as<\/p>\n
compensation under section 357(1) of the Code of<\/p>\n
Criminal Procedure.\n<\/p>\n

    Revision is allowed in part.       Conviction of<\/p>\n
revision petitioners for the offence under section<\/p>\n
138 of Negotiable Instruments Act is confirmed.<\/p>\n
Sentence      is     modified.    First     revision<\/p>\n
petitioner\/first accused   is sentenced to a fine of<\/p>\n
Rs.10,000\/-.      Second revision  petitioner\/second<\/p>\n
accused     is sentenced to imprisonment till rising<\/p>\n
of court and a fine of Rs.1,20,000\/- and in default<\/p>\n
simple imprisonment for one month.    On realisation<\/p>\n
of  fine,    Rs.1,25,000\/- to   be  paid  to  second<\/p>\n
respondent as compensation under section 357(1) of<\/p>\n
