He submitted that report dated 9.2.2009 was relied on for<br \/>\n\tpassing the impugned order. He further submitted that petitioner had<br \/>\n\tspecifically demanded the statements of the villagers. He further<br \/>\n\tpointed out  that under similar circumstances, revisional authority<br \/>\n\thad remanded the proceedings for fresh consideration after supplying<br \/>\n\tnecessary documents.\n<\/p>\n<p>Learned<br \/>\n\tAGP contended that report dated 9.2.2009 was not foundation for<br \/>\n\tcancellation of license. Documents demanded by the petitioner were<br \/>\n\tsupplied. She however, was not in a position to dispute that<br \/>\n\tstatements of villagers were not supplied though asked for and that<br \/>\n\ton the ground of non supply of the report in case of other persons,<br \/>\n\trevisional authority had remanded proceedings.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, impugned order dated 26.6.2009 is quashed.<br \/>\n\tProceedings are remanded to the authority for fresh consideration in<br \/>\n\taccordance with law after supplying report dated 9.2.2009 as well as<br \/>\n\tstatements of villagers recorded by the authority. Remand<br \/>\n\tproceedings shall be disposed of within six months. It is clarified<br \/>\n\tthat till fresh order is passed, petitioner shall not insist on<br \/>\n\toperating license.\n<\/p>\n<p>Petition<br \/>\n\tis disposed of.
