Delay condoned.\n<\/p>\n<p>2.   Notice  was given for final disposal of the  matter  at<br \/>\nthis  stage.  Leave granted.  Both sides have been heard  on<br \/>\nmerits.\n<\/p>\n<p>3.The respondent was employed as a Technician in the Post<br \/>\nand  Telegraph\tDepartment  of the Union  of  India.   While<br \/>\nworking\t in  that  capacity, the  respondent  assaulted\t his<br \/>\nsuperiors  including an Engineering Supervisor for which  he<br \/>\nwas prosecuted.\t The respondent was convicted of the offence<br \/>\npunishable  under  Section 332 IPC and\tthe  conviction\t was<br \/>\nmaintained up to the High Court.  Thereafter, the respondent<br \/>\nwas compulsorily retired by an order dated 10-5-1982  passed<br \/>\nby the Divisional Engineer (Phones), Varanasi after<br \/>\n+  Arising out of SLP (Civil) No. 7611 of 1993<br \/>\n<span class=\"hidden_text\">397<\/span><br \/>\ngiving\t him   a  show-cause  notice   and   the   requisite<br \/>\nopportunity.   The  respondent\thas been  paid\tthe  retiral<br \/>\nbenefits on his compulsory retirement.\n<\/p>\n<p>4.The respondent challenged his compulsory retirement  by<br \/>\nfiling\ta suit in the Court of City Munsiff, Varanasi  which<br \/>\nwas  transferred  to the  Central  Administrative  Tribunal,<br \/>\nAllahabad Bench.  By the impugned order dated 3-9-1992,\t the<br \/>\ntransferred   case  has\t been  allowed\tand  the  order\t  of<br \/>\ncompulsory  retirement of the respondent has  been  quashed.<br \/>\nHowever,  the  tribunal has not awarded back  wages  to\t the<br \/>\nrespondent.   The respondent had preferred a  special  leave<br \/>\npetition challenging the tribunal&#8217;s order refusing the\tback<br \/>\nwages to him but that SLP has already been dismissed.\tThis<br \/>\nappeal by special leave is by the Union of India against the<br \/>\ntribunal&#8217;s  order quashing the compulsory retirement of\t the<br \/>\nrespondent.\n<\/p>\n<p>5.The  undisputed  facts of this case are  sufficient  to<br \/>\nindicate  that there can be no ground for  interfering\twith<br \/>\nthe  compulsory retirement of the respondent who appears  to<br \/>\nhave been dealt with lightly notwithstanding his  conviction<br \/>\nunder Section 332 IPC for assaulting his superior  officers.<br \/>\nThe  compulsory\t retirement  made  in  these   circumstances<br \/>\ntogether  with grant of all retiral benefits was  the  least<br \/>\naction\twhich could have been taken against the\t respondent.<br \/>\nThe tribunal clearly misunderstood the scope of its power in<br \/>\na  case like this and clearly erred in interfering with\t the<br \/>\norder  of  compulsory retirement on grounds  which,  in\t our<br \/>\nopinion,  were\tnot available to it.  The  tribunal&#8217;s  order<br \/>\nhas,  therefore, to be set aside, insofar as it quashes\t the<br \/>\norder of compulsory retirement of the respondent.\n<\/p>\n<p>6.Consequently,\t the  appeal is\t allowed.   The\t impugned<br \/>\norder  of the tribunal to the extent indicated is set  aside<br \/>\nresulting in dismissal of the respondent&#8217;s transferred\tsuit<br \/>\ndisposed of by the tribunal.
